Domestic Partner Benefits
On May 20, 2008, the Board of County Commissioners adopted an Ordinance to amend the Miami-Dade County Code to provide health insurance eligibility and other benefits to the domestic partners of Miami-Dade County employees. This provision applies to both same sex and common law relationships. County benefit plans that are otherwise available to an employee’s spouse and dependent children (health, dental, vision, and group legal plan) will be available to domestic partners and their dependent children, effective January 1, 2009.
To enroll a domestic partner and/or children of a domestic partner in a County-sponsored benefit plan for the 2009 plan year, the employee and domestic partner must obtain a Certificate of Domestic Partnership from the Miami-Dade County Consumer Services Department. Beginning October 14, employees will be able to submit their 2009 Open Enrollment online adding their domestic partner (and/or children of their domestic partner).
The 2009 Open Enrollment period will take place October 14 through November 14, 2008. The employee must submit a copy of the Certificate of Domestic Partnership directly to the health plan during the open enrollment period, but no later than December 15. Please note that under current IRS rules, insurance premiums for a domestic partner and/or domestic partner’s children must be deducted on a post-tax basis and subject to imputed income tax, unless the domestic partner/dependents qualify as the employee’s tax dependent. Domestic partners and their children are not eligible for expense reimbursement through a healthcare or dependent care spending account.
