What Happens If I get Hurt?

  • All job injuries must be reported immediately to employee’s supervisor.
  • If you do not need medical treatment, the injury/incident should be recorded on the Minor Injury LogAdobe Reader.
  • If medical care is needed, the supervisor or employee must report job injury to Teleclaim by calling 1-877-632-7475 the same day or as soon as possible.
  • Effective 12/03/2009 the employee ID number, must be presented to Teleclaim.
  • The supervisor must complete a Supervisor Investigation ReportAdobe Reader, within 48 hours of the injury being reported.
  • The supervisor cannot refuse to report a job injury or try to convince the employee not to report a job injury.
  • If medical treatment is necessary, 911 will be called for emergency treatment. If the employee needs non emergency care, he will be sent to an Authorized Care Center or emergency room. All follow up care must be authorized by Risk Management.
  • The employee must return to work full duty or light duty when released by the Worker’s Compensation doctor.
  • Employee must present the doctor’s note to their supervisor when they return to work.
  • It is a Felony to file a false or misleading claim.
  • Statute of limitations – Per state law, once you become aware of an injury at work, you have 30 days to report it. Failure to report it within 30 days may be used as a defense against your claim even though you legally have two years from the date of your injury in which to file a claim. Your eligibility for benefits may also be eliminated one year from the date your last received wage replacement benefits or approved medical care or treatment.
Workers Compensation/Service Connected Disability Leave: Two separate Benefits
  • Workers’ Compensation falls under State law; Disability Leave is a County program. The decisions on benefits are made by the Risk Management Division.
  • Workers’ Compensation pays 66 2/3% of employee’s salary, or maximum amount permitted for that year per state law. 
  • Disability Leave, if approved, usually pays up to 80% of salary, for a limited period of time.
  • Workers’ compensation benefits are not payable unless more than seven days of work are missed. Disability Leave pays from day after the injury.
  • Payment is subject to medical verification-and determination that work comp claim is accepted.
No disability Benefits are payable if:
  • Accident was caused by employee’s negligence or willful conduct.
  • Employee is a temporary employee.
  • Employee was not actually performing work duties at the time of the injury.
Pay
  • Employee will receive full regular pay for the day of injury.
  • Only workers’ compensation benefits will be paid until decision is made on compensability of the injury. 
  • Until a decision is made on entitlement to benefits, the employee’s sick, annual, or holiday leave is borrowed to pay the employee if they are losing time as a result of a job injury.
  • If employee has no accrued leave, employee will only receive workers’ compensation benefits,  if any,  unless and until Service Connected Disability is approved.
  • There is a 7-day waiting period before entitlement to workers’ compensation wage benefits. If more than 21 days are missed, workers' compensation benefits will then be paid for that first week and any time used will be restored for the amount of that disability payment.
  • Employee cannot receive more than his/her normal bi-weekly salary. Workers’ Compensation checks mailed to employee’s home will be deducted from the employee’s normal biweekly paycheck.
  • If disability leave is granted, leave will be restored as follows: 80% (if hired after 5/1/1979) and 100% (if hired before 5/1/1979), less any workers compensation benefits paid. The remaining 20% will still be charged to any available leave time.
  • Disability leave entitlement is  for 120 calendar days. An extension may be approved for a second 120 calendar days.

Call as soon as possible after the incident. You will be asked to provide information pertinent to the claim including:

  • Employee ID number of the injured person.
  • Name, Address and Telephone number of the injured employee(home & work).
  • Name and Telephone number of the Supervisor.
  • Department name.
  • Date and time of incident.
  • Description of incident (how, where, why?)
  • Type of injury (cut, scrape, burn, etc.)
  • Body part injured.
  • Witnesses (name, address, phone no).
