The 2009 Hurricane Season is here! June 1st thru November 30th

Are you equipped, organized and informed about hurricane preparations, what to do when a storm approaches, what to do during a storm, and what to do after a storm?

For this and more information about the 2009 Hurricane Season please visit the 2009 Hurricane Guide Web Site.

     BCCO’s Product Control NOA’s Going Green !

The Green Sustainable Attributes (GSA) is a new program, created by the Product Control Division, designed to provide a vehicle to verify and confirm the Green Attributes for products and or systems which have a Miami-Dade County Notice of Acceptance (NOA).

Available starting June 2009, this voluntary program will provide the NOA holders, Architects, Engineers, and the public, valuable information in the form of a new Green Page contained in the NOA. Those seeking to qualify for points under major green rating systems will find this information extremely helpful.  Current NOA holders will have the option to revise their NOA’s to include the Green Page, and new NOA applicants can submit GSA information together with their NOA application.  Checklists and guidelines for the confirmation of any Green Sustainable Attributes have been developed and are now available under the Product Control Forms section.

The effective date for the 2007 Florida Building Code has been postponed to March 1, 2009.

During the September 15, 2008 conference call meeting, the Florida Building Commission decided to postpone the effective date of the 2007 Florida Building Code from December 31, 2008 to March 1, 2009.

The purpose of the delay was to provide additional time [due to cancellation of the August 2008 meetings] necessary to review and take action on the proposed glitch code changes and to allow both the glitch code change supplement including the 15% increase in energy efficiency of buildings and the first edition of the 2007 Florida Building Code to go into effect at the same time as planned.

To view the proposed 2007 Edition of the Florida Building Code, code modifications and Florida Building Commission meeting schedules and agendas please go to the Florida Building Commission Web Site.

     BCCO Statement Regarding Chinese Drywall

The Building Code Compliance Office (BCCO) has recently become aware of issues stemming from the use of Chinese drywall in new homes and other buildings.  Residents should be aware of the fact that the Florida Building Code (FBC) only requires product approval (either with Miami Dade or through the optional State Product Approval System) of those construction products that comprise the building's envelope.

All other products (typically contained inside the building and not subject to wind) show compliance with the code through listings the manufacturers hold from nationally recognized testing/listing agencies.

The Lennar Building Company recently issued a statement about the use of Chinese drywall in some of their housing developments. You may click on the link below to read an article about the Chinese drywall issue and Lennar’s statement.

There Is a Lot of Green Going On at BCCO

If you are looking for the latest on Green Building, please see our new page under “Resources”.

Court Orders Preliminary Injuction of the Crane Safety Ordinance

On May 22, 2008 United States District Court Judge Ursula Ungaro, entered a preliminary injunction enjoining the enforcement of significant portions of Miami-Dade County Ordinance No. 08-34, “Ordinance Relating to the Safety of Cranes and Other Hoisting Equipment; Providing Definitions; Providing Standards for Manufacture and Installation; Providing for Education and Certification of Operators; Establishing Standards for Hurricane Preparedness; Providing for Enforcement; Creating Chapter 8E of the Code; Providing Severability, Inclusion in the Code, and an Effective Date” (the “Crane Ordinance”).

The Court concluded that portions of the Crane Ordinance are preempted by federal law, specifically, the Occupational Safety and Health Act of 1970, 29 U.S.C. § 651 et seq. (“OSH Act”) and standards promulgated by the Occupational Safety and Health Administration (“OSHA”).  Among the portions of the Crane Ordinance that the Court deemed was preempted was the Crane Ordinance’s incorporation of hurricane wind load standards pertaining to tower cranes.

The Court, however, did conclude that several portions of the Crane Ordinance are not preempted under federal law, including provisions relating to crane siting and hurricane preparedness for cranes.  The portions of the Crane Ordinance that the Court concluded are not preempted were not enjoined and remain enforceable.
