    Alternative Plan Review and Inspection Program

    In 2002 the Florida Legislature passed legislation Section 553.791, F.S. PDF  authorizing the use of private providers to conduct plans review and inspections services.  With the passage of this legislation, the Alternative Plan Review and Inspection program was implemented October 1, 2002. View “Alternative Plan Review and Inspection” presentation (ppt).

    This program allows the “Fee Owner” the option of using a Private Provider to conduct plan review and inspection duties in lieu of the municipal building department personnel. 

    The Building Code Compliance Office (BCCO) must register all architects, engineers and individuals certified under part XII of Chapter 468 of the Florida Statutes who apply to participate in the Alternative Plan Review and Inspection Program for Unincorporated Miami-Dade County. BCCO must implement an on-line automated information system to provide building departments with instant notification regarding the status of any registered person in order to facilitate issuance of permits under the Alternative Plan Review and Inspection process. 

    As a condition of registration, participating individuals shall provide the Chief Building Code Compliance Officer documentation indicating their services have been retained for a specific project within Unincorporated Miami-Dade County, proof of appropriate licensure of each Private Provider and Duly Authorized Representative and proof of professional and comprehensive general liability insurance in the type and amounts required by State law. 

    Pursuant to Florida Statute 553.79 the Florida Building Commission has established forms to be used when participating in the Alternative Plan Review and Inspection Program. Notice to Building Official of Use of Private Provider is a form indicating that the fee owner has elected to participate in the Alternative Plan Review and Inspection Program. This form also includes information regarding the project, the qualifications of the Private Providers and Duly Authorized Representatives, as well as, proof of the requisite professional and liability insurance coverage.  The Private Provider Plan Compliance Affidavit form is used by the Private Provider to attest to the Building Official that the plans submitted by the Private Provider were reviewed for and are in compliance with the Florida Building Code and all local amendments to the Florida Building Code. 

    Effective July 1, 2005 changes relative to Florida Statute 553.791 are to be implemented. These changes will influence the initial registration process utilized by the Building Code Compliance Office (BCCO), for new Private Provider entities. 

    Additionally, the currently registered Private Providers will be required to re-register with BCCO when applying to the Unincorporated Miami-Dade County Building Department for a permit with an application date of July 1, 2005 or later. 

    Re-registration is necessary in order to verify that the issuing insurance company, the type of insurance and the coverage amounts are consistent with the statutory requirements. Also verification that the Duly Authorized Representatives are employees of the Private Provider, subject to receive unemployment compensation benefits under Florida Statute 443 will be confirmed, as well. This verification will be accomplished using the “Duly Authorized Representative Employment Affidavit”.

    BCCO will maintain separate listings of Private Providers and Duly Authorized Representatives on our web page. One list will contain those registered for projects applied for prior to July 1, 2005 and another listing will reflect those meeting the new requirements of F.S. 553.791 and registered for projects applied for July 1, 2005 or later.

    When participating in the Alternative Plan Review and Inspection Program, the following forms are required:

    • Duly Authorized Representatives Employment Affidavit PDF  
      Effective July 1, 2005 changes relative to Florida Statute 553.791 will be implemented.
