    Property Covenants

A covenant is generally a binding agreement made between a property owner and Miami-Dade County that restricts the use of that property.  This may be the only way in which a certain type of activity may be permitted with that property.

The land use restrictions requiring covenants can be broken down into three categories; 1) Restricted land use within a Wellfield Protection Area, 2) Restricted Land use due to the use of a septic tank, 3)  Restricted Land Use to protect a natural resource.

Land Use Restrictions Based On Covenants

Category 1 Properties within a Wellfield Protection Area
Section 5(a) covenant  Any non residential land use within a wellfield Protection Area
Section 5(c)(iii) covenant   The limited expansion of a facility generating a hazardous waste located within a Wellfield Protection Area
Section 7(a) covenant   Open excavation with the Northwest and/or West Wellfield Protection Area (Rock Mining Operations)
Category 2 Properties served by a Septic Tank
Section 4(a) covenant   Any non-residential land use served by a septic tank
Section 6(c) covenant  Connection to sewers requires prior to the approval of any plats, building permits, or CO’s
Category 3 Protection of Natural Resources
Environmentally Endangered Lands Covenant: Protection of trees, wetlands, forest community, etc.
