(Miami-Dade County, FL) -- Commissioner Jose “Pepe” Diaz sponsored an ordinance providing that Miami-Dade County retains jurisdiction to modify or delete covenants pertaining to zoning applications approved by the Board of County Commissioners. The ordinance received initial approval at the Infrastructure and Land Use Committee on December 12, 2012 and will be discussed for final action during tomorrow’s Commission meeting. If approved, the ordinance would protect covenants approved as part of zoning or CDMP applications by requiring any modifications to be approved by the BCC in areas that have been annexed or incorporated subsequent to the approval of the covenant.
This ordinance requires as a condition that each new municipality provide the Board of County Commissioners jurisdiction over any modification or deletions to covenants accepted by the same Board or a Community Zoning Appeals Board, regardless of whether such declaration provides for modification or deletion by a municipality governmental body.
