RESOLUTION RELATING TO AN APPLICATION BY THE EDIAN CORPORATION, THE CARLSON USA CORPORATION, INTERLAGOS, N.V., SHOPPYLAND ENTERPRISES, N.V., YALE MOSK AS TRUSTEE, FLORIDA ROCK INDUSTRIES, INC., TALTON ENTERPRISES, N.V., AND MR. STEVEN D. ROBINSON FOR A CLASS IV PERMIT TO IMPACT APPROXIMATELY 307 ACRES OF WETLANDS FOR A COMMERCIAL AND INDUSTRIAL OFFICE AND WAREHOUSE FACILITY BETWEEN THEORETICAL NORTHWEST 117 AND 137 AVENUES AND BETWEEN NORTHWEST 12 AND 25 STREETS IN SECTIONS 35 & 36, TOWNSHIP 53 SOUTH, RANGE 39 EAST, MIAMI-DADE COUNTY, FLORIDA

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board having considered all the applicable factors contained within Section 24-58.3 of the Code of Miami-Dade County, hereby approves the application of the Edian Corporation, the Carlson USA Corporation, Interlagos, N.V., Shoppyland Enterprises, N.V., Yale Mosk as Trustee, Florida Rock Industries, Inc., Talton Enterprises, N.V., and Mr. Steven D. Robinson for a Class IV Permit to impact approximately 307 acres of wetlands for a commercial and industrial office and warehouse facility in Miami-Dade County, Florida, subject to the conditions set forth in the memorandum from the Director of the Miami-Dade County Department of Environmental Resources Management, a copy of which is attached hereto and made a part hereof. The issuance of this approval does not relieve the applicant from obtaining all applicable Federal, State and local permits.

307 acres of Wetlands for a
Commercial and Industrial Office
and Warehouse Facility

STAFF RECOMMENDATION
I have reviewed the Class IV Permit application from the applicants referenced above. Based upon the applicable evaluation factors set forth in Section 24-58.3 of the Code of Miami-Dade County, I recommend that the Board of County Commissioners approve the aforesaid application for the reasons set forth below.

MANAGER'S BACKGROUND
The subject Class IV Wetland Permit application involves the impact of approximately 307 acres of jurisdictional wetlands for a commercial and industrial office and warehouse facility within the Transitional Northeast Everglades Wetland Basin. The subject property is located between theoretical Northwest 117 and 137 Avenues and between Northwest 12th and 25th Streets in Sections 35 & 36, Township 53 South, Range 39 East, Miami-Dade County, Florida.

This project has undergone extensive reviews in the analyses completed for the Comprehensive Development Master Plan Amendment (Ordinance No. 02-85 adopted on May 30, 2002), the Development of Regional Impact Order (Resolution No. Z-11-02 adopted on May 30, 2002, and subsequently revised on June 28, 2002), the Environmental Quality Control Board Order (No. 01-82 adopted on November 8, 2001) and the Individual Environmental Resource Permit Staff Report that is scheduled to be presented to the South Florida Water Management District's Governing Board on December 12, 2002.

Compensatory mitigation for the ecological impacts related to the removal of wetland plant communities will be provided by purchasing 167.73 credits within the Everglades Mitigation Bank managed by Florida Power and Light and the Hole-in-the-Donut Mitigation Bank managed by Everglades National Park and by preserving 40.61 acres of wetlands and tree island communities on-site.

The proposed project has been designed in accordance with all relevant Miami-Dade County wetland criteria and is consistent with all other Miami-Dade County wetland protection provisions. Please find attached a Project Report from the DERM Wetland and Forest Resources Section, which outlines in more detail the reasons the project is recommended for approval by DERM pursuant to the applicable evaluations factors set forth in Section 24-58.3 of the Code of Miami-Dade County, Florida. The conditions, limitations, and restrictions set forth in the Project Report attached hereto are incorporated herein by reference hereto.
