TITLE
RESOLUTION URGING THE IMMIGRATION AND NATURALIZATION SERVICE (INS) TO IMMEDIATELY RELEASE THE UNACCOMPANIED HAITIAN CHILDREN WHO ARRIVED ON THE OCTOBER 29 BOAT EXODUS AND WHO ARE CURRENTLY BEING HELD IN INS CUSTODY TO FAMILY SPONSORS IF SUCH SPONSORS ARE AVAILABLE AND, IF NOT, TO FOSTER CARE

BODY
WHEREAS, on October 29, 2002 11 unaccompanied children were apprehended and detained by the INS after reaching U.S. shores; and
WHEREAS, these children were handcuffed with plastic restraints during transport to their detention locations; and
WHEREAS, due to confinement in hotel rooms the children had no access to education, learning activities, recreation, fresh air or physical exercise; and
WHEREAS, several uniformed guards with firearms and handcuffs monitored the hallway at the hotel; and
WHEREAS, the Haitian children being held at the hotel were virtual prisoners in their rooms for 11 days before being moved to Boystown; and
WHEREAS, some of those children have been forcibly separated from their fathers who are detained at Krome; and
WHEREAS, the Board of County Commissioners is aware of 11 unaccompanied Haitian children who were moved from the hotel to Boystown on or about November 8, 2002; and
WHEREAS, seven of the children have family sponsors in the United States who are able and willing to care for them; and
WHEREAS, these children have suffered severe trauma as a direct result of their journey at sea for eight days and have already been in INS custody for 39 days; and
WHEREAS, children are the most vulnerable members of our immigrant community and should be kept in INS detention only in exceptional circumstances,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board urges the INS to immediately release the seven children with family sponsors to their sponsors and to immediately transfer the four children without sponsors to foster care.
