REPORT: The Board considered the foregoing proposed ordinance simultaneously with its companion agenda item 7A2A. Commissioner Moss discussed his intent of the foregoing proposed items that would protect employees who disclose information concerning illegal and other improper conduct at the Aviation Department. Commissioner Moss directed the County Attorney to draft legislation to provide the same procedures and protection outlined in agenda item 6D pertaining to section 2-56.28.15 of the Code for all County employees who disclose information relating to all County departments. Commissioner Sorenson requested she be listed as a cosponsor on the foregoing draft legislation, proposed by Commissioner Moss. Commissioner Heyman requested she be listed as a cosponsor on ordinance 6D and resolution 7A2A. County Manager Steve Shiver pointed out currently the Inspector General had a hotline for this purpose.

REPORT: Chairperson Moss announced that the foregoing proposed ordinance was open for public participation, and there being no persons to appear before the Committee, the public hearing was closed. As sponsor of the foregoing proposed ordinance, Chairperson Moss relinquished the chair to Vice Chairperson Barreiro. He noted the proposed ordinance would amend the existing ordinance to provide for employees to report violations directly to the Ethics Commission.

TITLE
ORDINANCE AMENDING SECTION 2-56.28.15 OF THE CODE OF MIAMI-DADE COUNTY, PROVIDING SUPPLEMENTAL PROCEDURES AND PROTECTIONS FOR EMPLOYEES WHO DISCLOSE INFORMATION CONCERNING THE AVIATION DEPARTMENT; PROVIDING FOR ENFORCEMENT, PROVIDING SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. Section 2-56.28.15 of the Code of Miami-Dade County, Florida, is hereby amended to read as follows:1

Sec. 2-56.28.15 To Whom Information Disclosed

>>(a) Except as set forth in subsection (b) hereof,<< [[T]] >>t<
>>(b) Employees with information, as defined in section 2-56.28.14, concerning the Miami-Dade Aviation Department shall disclose such information directly to the County Ethics Commission. Employees who disclose such information to the Ethics Commission shall be entitled to the full protection of this ordinance and to the remedies and awards it provides.<<
Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 3. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance, including any sunset provision, shall become and be made a part of the Code of Miami-Dade County, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word.
Section 4. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
