TITLE
RESOLUTION AUTHORIZING CREATION OF A CHARTER COMMISSION FOR A NEW MUNICIPALITY IN MIAMI-DADE COUNTY, FLORIDA CURRENTLY KNOWN AS DORAL

BODY
WHEREAS, Section 5.05 of the Dade County Home Rule Charter provides that the Board of County Commissioners appoint a Charter Commission consisting of five electors residing within the proposed boundaries of a municipality; and
WHEREAS, the County Commission by Resolution No. R-1358-02, adopted on November 19, 2002, called a special election for January 28, 2003, for the purpose of submitting to the electors voting and residing within the proposed boundaries the question of whether the County Commission shall be authorized to create such new municipality; and
WHEREAS, at the election duly held on January 28, 2003, the creation of such new municipality was approved by a majority of the electors voting and residing within the proposed boundaries; and
WHEREAS, the Doral Area Municipal Advisory Committee has met and submitted its report outlining a conceptual agreement between the City of Doral (or such other name[s] as the Charter Commission submits) and the County for provision of services to the City by the County; and
WHEREAS, based upon the report of the Doral Area Municipal Advisory Committee, and the conditions set forth for incorporation in the County Manager's Memorandum to the County Commission dated October 7, 2002, the County may be desirous of creating the City of Doral, if the proposed City's charter establishes, among other things, that the County will provide certain fire, library, solid waste and police services to the new city and that the City pay into the Municipal Services Trust Fund the equivalent of 1.5 mill of property taxes,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that a Charter Commission for the new municipality is hereby created and established, consisting of five electors residing within the boundaries of Doral which are described in Attachment A, which is incorporated herein by reference. The Charter Commission shall propose a municipal charter that may be submitted to the electors residing within the boundaries of Doral at a special election that may be called by the County Commission, after adoption of an ordinance creating the City of Doral, upon condition that the proposed municipal charter is approved by the electors residing within the boundaries of the proposed municipality. The following electors and residents of Doral are hereby appointed as members of the Charter Commission:
1. Jerome Reisman
2. Morgan Levy
3. Alicia Casanova
4. Ernesto Anton
5. Santiago Sellan
The members of the Charter Commission shall select such officers as may be deemed necessary or desirable. The appointments herein made shall become effective immediately upon each member filing with the Clerk of the County Commission his or her acceptance of such appointment and oath of office.

A Portion of Miami-Dade County, Florida, more particularly described as follows:

BEGINNING at the Northeast corner of Section 8, Township 53 South, Range 40 East in Miami-Dade County, Florida, said corner also being the intersection of the Center line of NW 90 Street with the Center line of NW 97 Avenue; thence Westerly following the Center Line of NW 90 Street along the North line of said Section 8, said line being also the South boundary line of the Town of Medley, to the West boundary line of said Town of Medley and the Northwest corner of said Section 8; thence continue Westerly following the Center line of NW 90 Street, along the North line of Section 7, Township 53 South, Range 40 East, to the Northwest corner of said Section 7; thence continue Westerly following the Center Line of the NW 90 Street, along the North line of Section 12 in Township 53 South, Range 39 East, to the Easterly Limited Access Right-of-Way line of State Road No. 821 (Homestead Extension of Florida Turnpike) as shown on the Florida State Department of Transportation Right-of-Way Map Section 87005-2310 dated May 20, 1970; thence Southerly, along said Easterly Limited Access Right-of- Way line of State Road No. 821 through Sections 12, 13, 24, and 25 in Township 53 South, Range 39 East, to the point of intersection with the Center Line of NW 25 Street, said line also being the South line of said Section 25; thence Easterly following the Center Line of NW 25 Street along the South line of said Section 25 to the Southwest corner of Section 30, Township 53 South, Range 40 East; thence continue Easterly along the South line of said Section 30, said line also being the Northerly Right-of-Way line of the NW 25 Street Canal, to the point of intersection with the Center Line of NW 107 Avenue, said point also being the Southeast corner of said Section 30; thence Southerly following the Center Line of NW 107 Avenue along the West line of Section 32, Township 53 South, Range 40 East, to the Southwest corner of said Section 32; thence continue Southerly along the West line of Government Excess Lot 5 between Township 53 and 54 South, Range 40 East, to the Northerly Limited Access Right-of- Way line of State Road No. 836 (Dolphin Expressway Extension) as shown on the Florida State Department of Transportation Right-of-Way Map Section 87200-2521 dated May 17, 1971; thence Easterly, along said Northerly Limited Access Right-of-Way line of State Road No. 836 through said Government Excess Lot 5 and Government Excess Lot 4, and through Sections 33 and 34 in Township 53 South, Range 40 East, and through Government Excess Lot 3, to the Easterly Limited Access Right-of- Way line of State Road No. 826 (Palmetto Expressway) as shown on the Florida State Department of Transportation Right-of-Way Map Section 8726-101 recorded in Road Plat Book 72 at Page 61 of the Public Records of Miami-Dade County, Florida; thence Northerly , along the Westerly Limited Access Right-of-Way line of State Road No. 826 (Palmetto Expressway) through Sections 34, 27, and 22 in Township 53 South, Range 40 East, to the Center Line of NW 58 Street; thence Westerly following the Center Line of NW 58 Street, along the North line of said Section 22 and the North line of Section 21, Township 53 South, Range 40 East, to the Northwest corner of said Section 21, said corner also being the intersection of the Center line of NW 58 Street with the Center Line of NW 97 Avenue; thence Northerly following the Center Line of NW 97 Avenue, along the East line of Section 17, Township 53 South, Range 40 East, and along the East line of said Section 8, to the Northeast corner of said Section 8, said corner also being the intersection of the Center line of NW 90 Street with the Center line of NW 97 Avenue, and the POINT OF BEGINNING.
