TITLE
RESOLUTION URGING THE GOVERNOR AND THE STATE LEGISLATURE TO REFRAIN FROM REDUCING, CUTTING OR ELIMINATING FUNDING FOR DELINQUENCY PREVENTION AND DIVERSION PROGRAMMING, DJJ PERSONNEL IN MIAMI-DADE COUNTY, AND OTHER SERVICES BEING REDUCED OR CUT FROM THE GOVERNOR'S BUDGET

BODY
WHEREAS, Governor Bush released his proposed FY 2003-2004 budget on January 21, 2003 and it eliminates funding for juvenile prevention/intervention services, shifts financial responsibility for pre-adjudication detention to the County, eliminates staff to assess juveniles arrested for misdemeanor offenses, eliminates treatment for delinquent girls, eliminates misdemeanor probation, day treatment and educational services for adjudicated offenders, reduces or shifts costs to Counties for other necessary, approved, proven services; and
WHEREAS, without these services as provided by the State, expenses are much higher for ameliorating circumstances after current juveniles begin their adult criminal careers; and
WHEREAS, for the County to assume responsibility for these services without intergovernmental support would be a hardship on Miami-Dade County Taxpayers; and
WHEREAS, if the Governor's proposal is approved by the Legislature, Miami-Dade County's juvenile justice continuum of services will cease to properly serve the wide variety of children with problems entering the system; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. The Governor and the State Legislature are urged to refrain from reducing, cutting, or eliminating funding for juvenile prevention/intervention programming, for staff to assess juveniles arrested for misdemeanor offenses, for treatment for delinquent girls, for misdemeanor probation.
Section 2. The Governor and the State Legislature are urged to refrain from shifting the financial burden to Counties for pre-adjudication detention and other necessary, approved, proven services for juveniles.
Section 3. The Clerk of the Board is directed to transmit a certified copy of this resolution to the Governor, the President of the Senate and the Speaker of the House, and the Chair of the Miami-Dade County Legislative delegation.
