REPORT: Commissioner Sosa directed staff to coordinate between the State and the County to ensure that anyone who provided services at a nursing home or an assisted living facility was trained to identify signs of abuse and neglect and encouraged to report that information to the proper authorities. She asked that a task force be established to evaluate elder abuse problems and to make recommendations to the Board. Commissioner Sorenson concurred with Commissioner Sosa's request, and she suggested staff rely on the expertise of those persons experienced in dealing with domestic violence and child abuse. Commissioner Barreiro directed County staff confer with State agencies and coordinate their efforts in connection with the foregoing elder abuse study.

TITLE
RESOLUTION AUTHORIZING THE COUNTY MANAGER THROUGH THE MIAMI-DADE HOUSING AGENCY TO FORM A TASK FORCE TO STUDY AND MAKE RECOMMENDATIONS ON THE DETECTION AND PREVENTION OF ELDER ABUSE AND/OR NEGLECT WITHIN ASSISTED LIVING FACILITIES

BODY
WHEREAS, Miami-Dade County has an estimated population of 2,289,683 and more than 500 Assisted Living Facilities (ALF); and
WHEREAS, thirteen percent (13 %) of the population of Miami-Dade County is comprised of persons 65 years or older; and
WHEREAS, the Agency for Health Care Administration currently conducts inspections of the ALFs located within Miami-Dade County; and
WHEREAS due to the limited number of inspectors assigned to perform these duties and the number of ALFs to be inspected, inspections are only conducted of each facility approximately every 18 months; and
WHEREAS, ALFs are subject to various annual site inspections by a variety of Miami-Dade County agencies for fire, health and environmental safety; and
WHEREAS, there is a need to increase the number of inspections of ALFs to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly; and
WHEREAS, by broadening the scope of the annual inspections that are conducted by various agencies, the well being of residents of ALFs could undergo more frequent observations and thereby assist in identifying potential abusive situations, cases of neglect and instances of exploitation of the elderly; and
WHEREAS, a variety of agencies on the state and local level participate in inspections of ALFs; and
WHEREAS, Miami-Dade County desires to develop a more comprehensive approach to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:

Section 1. This Board directs the County Manager, through the Miami-Dade Housing Agency, to form a task force, to include appropriate state and local representatives, to study and make recommendations on the detection and prevention of elder abuse and/or neglect in Assisted Living Facilities within Miami-Dade including but not limited to:
* The efficacy of broadening the scope of routine Miami-Dade County inspections and the role of county inspectors to include the observance of elder abuse;

* The efficacy of forming interdisciplinary teams with other Miami-Dade County departments and the Agency for Health Care Administration and the Local Ombudsman Council, funded through the Florida Department of Elder Affairs and developing a mechanism to train and use Miami-Dade County inspectors to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly; and

* The efficacy of developing and implementing a program to utilize interdisciplinary teams that would involve community level activities to promote available services to the elderly and their caregiver(s).

Section 2. The County Manager, through Miami-Dade Housing Agency, shall prepare said recommendations in writing for presentation to the appropriate Committee of the Board of County Commissioners.
