TITLE
RESOLUTION URGING THE SUPPORT AND PASSAGE OF THE HAITIAN REFUGEE IMMIGRATION FAIRNESS ACT OF 2003

BODY
WHEREAS, United States Representative Kendrick Meek has introduced the Haitian Refugee Immigration Fairness Act (“HRIFA 2003”) on October 2, 2003; and
  WHEREAS, the HRIFA 2003 is designed to enable more Haitian refugees to become permanent residents pursuant to the Haitian Refugee Immigration Fairness Act of 1998 (“HRIFA 1998”); and
WHEREAS, the HRIFA 2003 eligibility requirements and applications dates will remain the same as the 1998 Act; and
WHEREAS, the HRIFA 2003 will expand coverage to most Haitian refugees who arrived in this country by air; forbid the government from deporting any Haitian refugee with a pending HRIFA application; and require the government to reopen and reconsider applications for adjustment of status under HRIFA 1998 that are affected by the HRIFA 2003 amendments; and
WHEREAS, due to government delays in drafting regulations and processing, many children whose parents applied for relief under the HRIFA 1998 have “aged out” or become adults under the law before their applications could be considered; and
WHEREAS, the HRIFA 2003 makes it possible to reopen these cases so that children will not be penalized for growing older before the government acted; and
WHEREAS, the HRIFA 2003 is a reasonable and responsible bill to improve the fairness of immigration laws,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. The Miami-Dade Board of County Commission urges the support and passage of the Haitian Refugee Immigration and Fairness Improvement Act of 2003.
Section 2. The Clerk of the Board is directed to transmit a certified copy of this resolution to the President of the U.S. Senate and the Speaker of the U.S. House of Representatives, the U.S. General Services Administration, and the Chair of the Miami-Dade County Legislative delegation.
