REPORT: Commissioner Sosa asked that the proposed resolution be amended to include not only Assisted Living Facilities, but any adult housing facility; to direct the County Manager to make recommendations on formation of a task force to include state and local representatives and to recommend membership to the Board; and delete language “through the Miami Dade Housing Agency”; and to include provisions to study and make recommendations regarding prevention of elder abuse and neglect in assisted living facilities, convalescent homes and any elderly facilities in Miami-Dade County. Commissioner Sosa indicated that the Task Force would study whether inspections would include facilities within municipalities. Commissioner Seijas suggested that Fire and Rescue Department, and an existing ombudsman program, elderly affairs and some aging and adult service programs should be involved in this effort. Commissioner Diaz requested he be listed as a cosponsor of the foregoing resolution. Commissioner Seijas requested that the Area Agency on Aging be added to the resolution.

TITLE
RESOLUTION AUTHORIZING THE COUNTY MANAGER TO RECOMMEND MEMBERS FOR A TASK FORCE AND TO FORM A TASK FORCE TO STUDY AND MAKE RECOMMENDATIONS ON THE DETECTION AND PREVENTION OF ELDER ABUSE AND/OR NEGLECT WITHIN ASSISTED LIVING FACILITIES NURSING HOMES, CONVALESCENT HOMES OR OTHER FACILITIES THAT HOUSE OR CARE FOR THE ELDERLY

BODY
WHEREAS, Miami-Dade County has an estimated population of 2,289,683 and more than 500 Assisted Living Facilities (ALF) nursing homes, and convalescent homes or other facilities that house or care for the elderly; and
WHEREAS, thirteen percent (13 %) of the population of Miami-Dade County is comprised of persons 65 years or older; and
WHEREAS, the Agency for Health Care Administration currently conducts inspections of the ALFs located within Miami-Dade County; and
WHEREAS due to the limited number of inspectors assigned to perform these duties and the number of facilities to be inspected, inspections are only conducted of each facility approximately every 18 months; and
WHEREAS, ALFs and other facilities that house or care for the elderly are subject to various annual site inspections by a variety of Miami-Dade County agencies for fire, health and environmental safety; and
WHEREAS, there is a need to increase the number of inspections of ALFs and other facilities to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly; and
WHEREAS, by broadening the scope of the annual inspections that are conducted by various agencies, the well being of residents of ALFs could undergo more frequent observations and thereby assist in identifying potential abusive situations, cases of neglect and instances of exploitation of the elderly; and
WHEREAS, a variety of agencies on the state and local level participate in inspections of ALFs; and
WHEREAS, Miami-Dade County desires to develop a more comprehensive approach to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. This Board directs the County Manager to report to the Board of County Commissioners on the necessary membership, including all appropriate state and local representatives within the field of elder affairs, of a task force to study and make recommendations on the detection and prevention of elder abuse and/or neglect in Assisted Living Facilities, nursing homes, convalescent homes or other facilities that house or care for the elderly within Miami-Dade.
Section 2. This Board further directs the County Manager, once said task force is constituted, to study and make recommendations on the detection and prevention of elder abuse and/or neglect in Assisted Living Facilities, nursing homes, convalescent homes or other facilities that house or care for the elderly within Miami-Dade to:
* The efficacy of broadening the scope of routine Miami-Dade County inspections and the role of county inspectors to include the observance of elder abuse;

* The efficacy of forming interdisciplinary teams with other Miami-Dade County departments and the Agency for Health Care Administration and the Local Ombudsman Council, funded through the Florida Department of Elder Affairs and developing a mechanism to train and use Miami-Dade County inspectors to identify potential abusive situations, cases of neglect and instances of exploitation of the elderly; and

* The efficacy of developing and implementing a program to utilize interdisciplinary teams that would involve community level activities to promote available services to the elderly and their caregiver(s).

Section 3. The County Manager shall prepare said recommendations in writing for presentation to the appropriate Committee of the Board of County Commissioners.
