REPORT: Commissioner Barreiro requested County Attorney Ginsburg determine the authority of the Miami-Dade Expressway Authority's administrative staff to approve change orders up to 25 percent of a project's cost, without approval by their Board of Directors.

REPORT: It was moved by Commissioner Rolle that the Committee forward the foregoing proposed resolution as presented. This motion was seconded by Commissioner Martinez, which passed by a vote of 4-0, (Commissioners Sosa and Souto were absent). Commissioner Martinez presented a motion to reconsider the foregoing item. This motion was seconded by Rolle, and passed by a vote of 4-0, (Commissioners Sosa and Souto were absent). Commissioner Diaz requested that the foregoing item be amended to add that the report should include the Commission District in which the construction project was taken place. Therefore, the respective commissioner was notified and aware of the construction project. Commissioner Martinez requested that the foregoing resolution be amended to include the following information in the monthly Construction Change Order report: (1) those County departments that use the most change orders, (2) the project timelines and departments that adhered and did not adhere to those timelines, (3) those departments that use or do not use the “notice to cure” and (4) a comparison of construction company performance under different project managers. The Committee by motion duly made, seconded and carried, forwarded the foregoing proposed resolution as amended.

TITLE
RESOLUTION DIRECTING COUNTY MANAGER TO SUBMIT TO THE BOARD MONTHLY CONSTRUCTION CHANGE ORDER REPORT

BODY
WHEREAS, the Board of County Commissioners is charged with the responsibility of approving change orders to construction contracts; and
WHEREAS, many of those change orders result from orders given in the field to address unforeseen conditions or to remedy errors or omissions in design documents when any applicable contingency account has been exceeded; and
WHEREAS, the Board often considers these change orders at a time when the work has already been fully done, all costs incurred and the contract time expired; and
WHEREAS, these change orders, to the extent that they relate to decisions already made and moneys already spent, do not allow the Board an opportunity for meaningful review and evaluation; and
WHEREAS, the Board does not wish to delay construction but wishes to be informed of situations which are likely to involve change orders at a time in which those situations can be addressed more meaningfully,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that the County Manager is hereby directed to present to this Board for review and approval, commencing 60 days from the date of this resolution, on a monthly basis, a construction contract change order report to contain for any construction project which exceeds $1 million dollars in cost an itemization of all changes directed, approved or negotiated as soon as reasonably known which in the aggregate are reasonably estimated to exceed 5 percent of the contract price; a description of the reason for the change; the approximate amount of the projected change order; the County Commission District (s) affected by the work; the number of change orders submitted by each department; the use of notices to cure; compliance with project timelines attributing delay to the responsible part and an estimate of when the change order will be scheduled for approval by the Board of County Commissioners.
