REPORT: Assistant County Attorney Daron Fitch, read the foregoing proposed resolution into the record. Commissioner Rolle explained the intent of the foregoing proposed resolution, noting the resolution was in response to children in the community operating motorized scooters and bikes in the streets. Commissioner Heyman spoke in favor of the resolution, and recommended an amendment to expand the Florida Statue that included motorized vehicles. Commissioner Martinez, as Chairperson of the Public Safety Committee, asked that Assistant County Attorney Scott Fabricius meet with Commissioners Rolle and Heyman to draft an amendment to Chapters 316, 320 and 322 of the Florida Statues to require that individuals who operate motorized scooters and mopeds on public roadways obtain licenses, title and registration and insurance. He asked that he be provided with a copy of the drafted language. It was moved by Commissioner Rolle that the foregoing proposed resolution be forwarded to the BCC with a favorable recommendation and with committee amendments. This motion was seconded by Chairperson Martinez and upon being put to a vote, passed by a vote of 5-0 (Commissioner Ferguson was absent). Hearing no other concerns or comments, Chairperson Martinez called for the next item on today’s (7/20) agenda.

TITLE
RESOLUTION URGING THE STATE OF FLORIDA DEPARTMENT OF HIGHWAY SAFETY AND MOTOR VEHICLES TO REQUIRE MOTORIZED SCOOTERS TO BE TITLED AND REGISTERED AND THEIR OPERATORS TO POSSESS A VALID DRIVER'S LICENSE AS MANDATED BY THE FLORIDA STATUTES

BODY
WHEREAS, each year there is a significant increase in the number of serious injuries and deaths related to the use of motorized scooters; and
WHEREAS, a motorized scooter is considered a motor vehicle in chapters 320 and 322 of the Florida Statutes; and
WHEREAS, the State of Florida Department of Highway Safety and Motor Vehicles ("Department") is mandated by chapters 320 and 322 of the Florida Statutes to require motor vehicles to be titled and registered and their operators to possess a valid driver's license; and
WHEREAS, the Department does not title, register and license motorized scooters,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. This Board urges the State of Florida Department of Highway Safety and Motor Vehicles to require motorized scooters to be titled and registered and their operators to possess a valid driver's license.
Section 2. The Clerk of the Board is directed to send a certified copy of this Resolution to Fred O. Dickinson, Executive Director, Department of Highway Safety and Motor Vehicles.
