REPORT: Assistant County Attorney Fitch read the foregoing proposed resolution into the record. Commissioner Seijas recommended that the foregoing proposed resolution be amended to provide that the County Manager shall present his written findings in the form of a report to the Board of County Commissioners in no less than 30 days from the effective date of this resolution, in lieu of the 120 days indicated in the resolution. The Committee forwarded the foregoing proposed resolution to the BCC as amended as recommended by Commissioner Seijas. Commissioner Seijas recommended that the foregoing proposed resolution be amended to provide that the County Manager shall present his written findings and report to the Board of County Commissioners in no less than 30 days from the effective date of this resolution in lieu of the 120 days.

TITLE
RESOLUTION DIRECTING THE COUNTY MANAGER TO PERFORM A STUDY AND SUBMIT A WRITTEN REPORT, INCLUDING RECOMMENDATIONS, ON MIAMI-DADE POLICE DEPARTMENT’S INTERACTION WITH PERSONS SUFFERING FROM MENTAL ILLNESS AND TO INCORPORATE THESE RECOMMENDATIONS INTO A PROGRAM TO BE KNOWN AS “THE MIAMI-DADE COUNTY POLICE DEPARTMENT MENTAL ILLNESS INTERVENTION PROGRAM”

BODY

WHEREAS, there are an estimated 200,000 individuals in Miami-Dade County suffering from mental illness; and
WHEREAS, the Miami-Dade Police Department has been called upon to interact many times with these individuals suffering from mental illness; and
WHEREAS, in the past weeks the Miami-Dade Police Department had a confrontation with an individual suffering from mental illness which resulted in Randy T. Baker’s unfortunate death; and
WHEREAS, this incident has sparked a need to reevaluate the policies, procedures and training of the way the Miami-Dade Police Department interacts with individuals suffering from mental illness,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. The County Manager is directed to create a program that will be known as “The Miami-Dade County Police Department Mental Illness Intervention Program” which will incorporate:
(a) The recommendations from the review of the present policies procedures and training of the Miami-Dade Police Department employees relating to confrontations involving Miami-Dade Police Department police officers and individuals suffering from mental illness;

(b) The establishment of Crisis Intervention teams which will have as their primary focus dealing with incidents involving the Miami-Dade Police Department and individuals suffering from mental illness;

(c) The training and policies in the use of tasers as an alternative to the use of lethal force in incidents involving confrontations with individuals suffering from mental illness.

Section 2. The County Manager shall consult with all appropriate persons in carrying out the directions of this resolution, including but not limited to, the Miami-Dade Police Department, the Community Relations Board, mental health professionals, other police agencies or departments that have addressed similar incidents, and institutions of higher learning.
Section 3. The County Manger shall present his written findings and report, including recommendations as to any appropriate corrective actions, to the Board of County Commissioners no more than (30) days from the date of this resolution.
