REPORT: Assistant County Attorney Cynthia Johnson-Stacks read into the record the amendment replacing the language of Section 1 as follows: “the County shall provide to the Municipal Advisory Committee an impact statement for each proposed municipality which projects revenues and expenditures based on existing service levels.” Assistant County Attorney Johnson-Stacks read into the record the amendment replacing the language of Section 2 as follows: “the County Manager is directed to retain an independent third party with expertise in government operations and financing to act as a consultant to review the County’s and the MAC’s budgeting and services impact analysis as contemplated by this resolution.” Assistant County Attorney Johnson-Stacks noted that other references to a pro forma budget in the foregoing proposed resolution would be changed to an impact statement, and the title would be modified as appropriate. Commissioner Gimenez suggested that the consultant or organization retained by the County Manager be completely independent from the MAC and all affected parties. Commissioner Jordan suggested that a recommendation be prepared on the selection process through the development of an agreement between the MAC and a County representative as well as a third party to prepare the recommendation on the proposed municipality. Commissioner Moss recommended that the feasibility of contracting the professional services of a university to conduct the independent budget analysis be reviewed.

TITLE
RESOLUTION ESTABLISHING COUNTY POLICY REGARDING THE PROVISION OF INDEPENDENT BUDGET AND SERVICE IMPACT ANALYSES FOR PROPOSED MUNICIPALITIES, DIRECTING THE MANAGER TO RETAIN SERVICES OF A CONSULTANT OR ORGANIZATION TO REVIEW COUNTY IMPACT STATEMENT AND MUNICIPAL ADVISORY COMMITTEE BUDGETING AND SERVICE IMPACT ANALYSES, AND REQUIRING NEW MUNICIPALITY TO REIMBURSE COUNTY FOR THE FEES AND COSTS ASSOCIATED WITH THE CONSULTANTíS SERVICES

WHEREAS, there is a need for residents of proposed new cities to understand the potential financial impact of the proposed incorporation of the area in which they reside,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. The County shall provide to the Municipal Advisory Committee (ďMACĒ) an impact statement for each proposed municipality, which projects revenues and expenditures based on existing service levels.
Section 2. The County Manager is directed to retain, subject to approval by the Board of County Commissioners, an independent third party with expertise in government operations and financing to act as a consultant to review the Countyís and the MACís budgeting and service impact analyses, as contemplated by this resolution.
Section 3. The consultantís report shall be an attachment to the report of the Municipal Advisory Committee and shall be orally presented and distributed to any reviewing board and the Board of County Commissioners. Additionally, this analysis shall be distributed to the public at all public hearings of the municipal advisory committee.
Section 4. If the proposed city is incorporated, the new city shall be required to include in its charter, as a condition of incorporation, that it agrees to reimburse the County for the costs and fees associated with the consultantís analyses performed pursuant to this resolution and any contracts entered into pursuant to this resolution.
