REPORT: Responding to Commissioner Seijas’ concern regarding the action date of the foregoing proposed resolution and the potential punish contractors for something they have no control over, Commissioner Sosa proposed to amend the action date from February 1, 2005 to May 1, 2005. She said this would allow time for personnel training, and allow time for departments to bring existing contracts into the system. She noted that she expected this would be done as soon as possible even though the date was moved. She clarified that both dates in this proposed resolution would be changed to May 1, 2005. Commissioner Seijas asked Mr. Roger Hernstadt, Director, Office of Capital Improvements, to provide a report to her committee in April 2005 that informed the County Commission that the contractor database was up to date. It was moved by Commissioner Sosa to adopt this proposed resolution as amended to change the action and award date from February 1, 2005 to May 1, 2005. This motion was seconded by Commissioner Seijas.

TITLE
RESOLUTION AFFIRMING THAT THE BOARD MAY DECLINE TO ACT ON ANY AGENDA ITEM SUBMITTED AFTER FEBRUARY 1, 2005, RELATING TO AN ARCHITECTURAL, ENGINEERING OR CONSTRUCTION CONTRACT OR TO A FIRM PERFORMING SUCH CONTRACT WHERE INFORMATION TRACKING CURRENT CONTRACT STATUS AND PERFORMANCE HAS NOT BEEN ENTERED IN A CENTRALIZED DATABASE ACCESSIBLE THROUGH THE COUNTY INTRANET FOR REFERENCE WHEN SUCH AGENDA ITEM IS CONSIDERED

BODY
WHEREAS, On April 13, 2004, Commissioner Rebeca Sosa sponsored, and the Board adopted Resolution No. R-442-04, directing the County Manager to recommend a system for tracking the steps taken during the procurement process; and
WHEREAS, the County has developed a database system capable of tracking all facets of the progress of architectural and engineering services projects and construction projects; and
WHEREAS, the analysis of the associated data collected in the tracking system will foster performance improvements,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board affirms that it may decline to act on any agenda item submitted after May 1, 2005, relating to an architectural, engineering or construction contract (or sub element thereof) awarded subsequent to May 1, 2005, or to a firm performing such contract for which current information tracking contract status and performance has not been entered into a centralized database as defined in Administrative Order 3-39. The data contained within the centralized tracking system shall contain, but not be limited to, data representing all contract origination actions, work orders with site and cost information, progress payments, contingency expenditures, change orders, official notices, and any other such information pertinent to the orderly tracking and administration of a capital project. Such data shall be promptly updated and available on the County intranet so that any County Commissioners may consider the firm's or project's history prior to consideration of related agenda items. This requirement shall not apply to agenda items regarding emergency contracts entered into pursuant to Section 8B of Miami-Dade County Code; however such emergency contracts shall be incorporated into the tracking system immediately thereafter.
