REPORT: Chairwoman Seijas opened the public hearing on this proposed ordinance. There being no one to appear, the public hearing was closed. The Committee forwarded the foregoing proposed ordinance to the Board of County Commissioners with a favorable recommendation with committee amendments to add to section (D) provisions that require members appointed or elected after the effective date of this ordinance to attend the new member orientation seminar prior to serving on a community council and to create a section (F), which provided that, notwithstanding Section 20-43.2 of the Code, failure of any elected or appointed member of the community council to attend an annual community council workshop shall be deemed sufficient cause for removal.

TITLE
ORDINANCE AMENDING SECTION 20-44 OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA; REQUIRING NEW COMMUNITY COUNCIL MEMBERS TO ATTEND NEW MEMBER ORIENTATION SEMINAR AND REQUIRING EXISTING COMMUNITY COUNCIL MEMBERS TO ATTEND ANNUAL ORIENTATION WORKSHOP; PROVIDING SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. Section 20-44 of the Code of Miami-Dade County, Florida, is hereby amended to read as follows:1
Sec. 20-44. Community Councils; organization>>; new member orientation; annual orientation workshop<<.

>>(D) Prior to serving on a Community Council, a Community Council member appointed or elected to a Council after the effective date of this ordinance shall attend a New Member Orientation Seminar conducted by the Department of Planning and Zoning, the Commission on Ethics, Team Metro and the County Attorney's Office. The seminar shall include, but shall not be limited to, a review of the Comprehensive Development Master Plan and issues related thereto, zoning regulations, incorporation and annexation issues, and a review of applicable laws, rules and regulations pertaining to duties and responsibilities of Community Council members.

(E) All Community Council members shall attend an Annual Community Council Workshop organized and conducted by the Department of Planning and Zoning, the Commission on Ethics, Team Metro and the County Attorney's Office. The Workshop shall include, but shall not be limited to, a review of the Comprehensive Development Master Plan and issues related thereto, zoning regulations, incorporation and annexation issues, and a review of applicable laws, rules and regulations pertaining to duties and responsibilities of Community Council members.

(F) Notwithstanding Sec. 20-43.2, failure of any elected or appointed member of a Community Council to attend an annual Community Council Workshop shall be deemed sufficient cause for removal.<<

Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 3. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance, including any sunset provision, shall become and be made a part of the Code of Miami-Dade County, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word.
Section 4. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
