REPORT: Assistant County Attorney Monica Maldonado read the title of the foregoing proposed resolution into the record. Chairwoman Heyman noted that United States Representatives Debbie Wasserman Schultz, Ileana Ros-Lehtinen, Mario Diaz-Balart, and Kendrick Meek would introduce Congregational Bill H.R.3823 at an emergency hearing on September 15, 2005. She said the delegation anticipated this Bill would pass in the Florida House of Representatives. She added that Senators Bill Nelson and Mel Martinez would sponsor this resolution in the Florida Senate. Commissioner Seijas asked the Intergovernmental Affairs Director to inform federal officials in Washington D.C. that members of the County Commission, particularly Commissioners Moss and Gimenez, were available to provide their knowledge and expertise in the Hurricane Katrina response efforts, particularly considering the fact that they had acquired hands on experience with emergency management issues in the aftermath of Hurricane Andrew and other serious storms.

TITLE
RESOLUTION URGING THE U.S. CONGRESS TO ENACT H.R. 3723 DIRECTING FEMA TO COVER VALID CLAIMS FOR INDIVIDUAL ASSISTANCE RESULTING FROM HURRICANE KATRINA'S IMPACT ON THE  STATE OF FLORIDA

BODY
WHEREAS, the Federal Emergency Management Administration (FEMA) has denied the State of Florida eligibility for Individual Assistance for damage from Hurricane Katrina, despite the fact that FEMA’s assessment revealed 152 homes destroyed or severely damaged in Miami-Dade County and 160 homes destroyed or severely damaged in Broward County; and
WHEREAS, FEMA does not want to provide assistance to Miami-Dade and Broward Counties because FEMA has determined that the State of Florida does not meet the “State Threshold” for such a declaration, which FEMA has set at a minimum of 800 homes destroyed or severely damaged; and
WHEREAS, FEMA has authority under section 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. Sections 5174-5204c and Title 44 of the Code of Federal Regulations (CFR) to provide financial assistance to eligible individuals and households who, as a direct result of a major disaster, have necessary expenses and serious needs and are unable to meet such expenses or needs through other means; and
WHEREAS, H.R. 3723 has been filed in the U.S. House of Representatives to direct FEMA to provide individual assistance to Floridians who suffered damage from Hurricane Katrina; and
WHEREAS, H.R. 3723 was filed by Representative Debbie Wasserman-Schultz and is co-sponsored by all the members of the Miami-Dade Congressional Delegation, Lincoln Diaz-Balart, Mario Diaz-Balart, Ileana Ros-Lehtinen and Kendrick Meek, along with the remaining 20 members of the Florida Congressional Delegation,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges Congress to enact H.R. 3723 directing FEMA to cover valid claims for individual assistance resulting from Hurricane Katrina’s impact on the State of Florida.
Section 2. Directs the County's federal lobbyists to advocate for passage of legislation consistent with Section 1 above, and directs the Office of Intergovernmental Affairs to include this item in the 2006 Federal Legislative Package.
Section 3. Directs the Clerk of the Board to transmit a certified copy of this resolution to the members of the Florida Congressional Delegation.
