REPORT: Assistant County Attorney Daron Fitch read the foregoing proposed ordinance into the record. The public hearing was opened by Chairwoman Sosa. The public hearing was closed after no one appeared wishing to be heard in connection with the foregoing proposed ordinance. Commissioner Sejias stated she did not support for-profit organizations receiving in-kind services and felt it was unacceptable to use taxpayers’ monies for this purpose. In response to Commissioner Sejias questions regarding funding sources for in-kind services, Miami Dade Fire Rescue (MDFR) Chief Herminio Lorenzo stated that the Department had an account set-aside for in-kind services. He recommended the funding sources for in-kind services be revisited or discontinued. Commissioner Sejias agreed with Mr. Lorenzo’s recommendation. In response to Commissioner Souto’s question regarding the use of the Fire Rescue’s budget for in-kind services, Ms. Jennifer Glazer-Moon, Director, Office of Strategic Business Management, stated a provision was contained within the Miami-Dade County Home Rule Charter stating countywide or unincorporated area general fund dollars could not be used in the Fire Rescue District Budget for district operations. She also noted that the in-kind reserve could not be used to reimburse the Fire District Budget. Commissioner Diaz requested a report listing all in-kind Services requests for for-profit organizations that have been submitted for County Commission approval from departmental budgets as well as those requests included in the budget without County Commission approval. He asked that this information be submitted to him as soon as possible and include the date(s) each request was approved and how each commissioner voted. In response to Commissioner Diaz’ question regarding funding for “for-profit” organizations, Ms. Jennifer Glazer-Moon stated that in the past other in-kind services and fee waivers had been approved for “for-profit” organizations. Commissioner Sejias asked Assistant County Attorney Daron Fitch to prepare a legal opinion on whether or not taxpayer’s monies could be used to fund for-profit organizations. Hearing no further questions or comments, Assistant County Attorney Daron Fitch announced the deferral of the foregoing proposed resolution to the Committee meeting scheduled for December 14, 2005.

TITLE
RESOLUTION RETROACTIVELY AUTHORIZING IN-KIND SERVICES FROM THE MIAMI-DADE POLICE DEPARTMENT AND THE MIAMI-DADE FIRE RESCUE DEPARTMENT FOR THE SEPTEMBER 18, 2005 ALTIRO PRODUCCIONES’ FESTIVAL CHILENO IN AN AMOUNT NOT TO EXCEED $8760.83 TO BE FUNDED IN PART FROM THE COUNTYWIDE IN-KIND RESERVE FUND AND IN PART FROM THE FIRE RESCUE DISTRICT BUDGET

WHEREAS, Altiro Producciones has requested in-kind services from the Miami-Dade Police Department and the Miami-Dade Fire Rescue Department for the September 18, 2005 Festival Chileno in an amount not to exceed $8760.83 (see attached Fee Waiver/In-Kind Service Application); and
WHEREAS, the Festival Chileno is a special event, as that term is defined in the attached Fee Waiver/In-Kind Service Application, and $1119.36 of the in-kind services shall be funded from the Fire Rescue District Budget, and $7641.47 of the in-kind services shall be funded from the Countywide In-Kind Reserve Fund,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board retroactively authorizes in-kind services from the Miami-Dade Police Department and the Miami-Dade Fire Rescue Department for the September 18, 2005 Festival Chileno in an amount not to exceed $8760.83, with $1119.36 of the in-kind services to be funded from the Fire Rescue District Budget, and $7641.47 of the in-kind services to be funded from the Countywide In-Kind Reserve Fund.
