REPORT: Commissioner Diaz provided a brief explanation as to why he was opposed to this resolution. Commissioner Sorenson stated for the record that shootings accounted for three quarters of the 551 workplace homicides in the United States last year (2004). She noted that employers located in eastern Florida needed to have the freedom to make their own rules without government interference with their privately owned property. Commissioner Gimenez provided a brief explanation of why he supported this resolution. Commissioner Heyman noted the high rate for crimes of burglary of a conveyance and of auto theft within the State of Florida. She further noted that in an effort to curtail thieves from getting possession of firearms, especially at schools, employees should leave their guns in a secure place. Following discussion, Chairman Martinez conducted a roll call vote and the motion failed to carry by a vote of 4-8 ( District-3 Vacant)

TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE TO DEFEAT LEGISLATION THAT WOULD BAN EMPLOYERS FROM PROHIBITING EMPLOYEES FROM HAVING GUNS IN THEIR LOCKED CARS AT WORK

BODY
WHEREAS, during the 2005 legislative session, the Florida Legislature passed a bill, SB 436, that significantly broadened the circumstances under which a person is allowed to shoot another in self defense; and
WHEREAS, bills have been filed for the 2006 legislative session, SB 206 and HB 109, that would ban employers from prohibiting employees from having guns in their locked cars at work; and
WHEREAS, figures from the Labor Department's Bureau of Labor Statistics show that shootings accounted for 75 percent of the workplace homicides in the United States last year; and
WHEREAS, a study published by the American Journal of Public Health has found that workplaces where guns are allowed are about five times more likely to experience a homicide as those where weapons are prohibited,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges lawmakers to defeat legislation that would ban employers from prohibiting employees from having guns in their locked cars at work.
Section 2. The Clerk of the Board is directed to transmit a certified copy of this resolution to the Chair and members of the Miami- Dade County State Legislative Delegation.
Section 3. This Board directs the County's state lobbyists to advocate against the passage of the legislation set forth in Section 1 above, and directs the Office of Intergovernmental Affairs to include this item in the 2006 State Legislative Package.
