REPORT: Chairman Martinez noted pursuant to Section 2-1, Rule 3.02 of the Code of Miami-Dade County, today’s special meeting had been scheduled, for the purpose of considering the filling of the vacancy in County Commission District 3, and an emergency ordinance extending the time for taxpayers to receive early payment discount on property taxes.

TITLE
EMERGENCY ORDINANCE EXTENDING THE TIME TO RECEIVE THE EARLY PAYMENT DISCOUNTS FOR THE PAYMENT OF TAXES; PROVIDING SEVERABILITY, AND AN EFFECTIVE DATE

BODY
WHEREAS, on December 9, 2005, the Florida Legislature enacted House Bill 15-B, 2005 Special Session B, which allows the governing body of any county that has been declared a major disaster area approved for individual assistance by the President of the United States to adopt a certain early-payment discount for the payment of taxes by emergency ordinance; and
WHEREAS, Miami-Dade County qualifies as a county that has been declared a major disaster area approved for individual assistance by the President of the United States; and
WHEREAS, enactment of this ordinance is an emergency because the last day to pay taxes under the first of the early discount periods provided by section 197.162 of Florida Statutes expires 30 days from the day the tax bills were issued, which falls on December 9, 2005,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. Subject to the conditions set forth in House Bill 15-B, 2005 Special Session B, and notwithstanding section 197.162, Florida Statutes, the property tax payment made by an owner of property is eligible for an early-payment discount as follows:
(a) Four percent for a payment made by January 31, 2006.
(b) Three percent for a payment made by February 28, 2006.
(c) Two percent for a payment made by March 31, 2006.
Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 3. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance shall not be made a part of the Code of Miami-Dade County, Florida.
Section 4. This ordinance shall not become effective until House Bill 15-B, 2005 Special Session B, becomes law.
Section 5. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
Section 6. This ordinance shall expire on April 1, 2006.
