REPORT: Assistant County Attorney Eugene Shy read the foregoing proposed resolution into the record. Chairwoman Sosa relinquished the Chair to Vice-Chairman Souto. She noted BCC Chairman Joe Martinez had initiated efforts to create a Domestic Violence Master Plan for the County prior to her being elected as a Commissioner and that she would not interfere with his efforts while proceeding with this resolution. She stated that as a school teacher for many years, she observed situations where children were affected by domestic violence and the intent of this resolution was to address those children. She asked Assistant County Attorney Abigail Price-Williams to read the proposed amendments into the record. Assistant County Attorney Abigail Price-Williams read into the record, the proposed amendments for this resolution. Commissioner Jordan suggested the County Manager’s Office coordinate with the Children’s Advocate Office to allow it to serve as a convener for the Alliance rather than just be a member. She noted her suggestion would not diminish the intentions of this resolution, but would allow the Children’s Advocate Office to call the groups of the Alliance together. Chairwoman Sosa stated she would address Commissioner Jordan’s request at the end of 120 days when all recommendations were brought back before this committee, but she wanted to allow other departments and agencies the opportunity to be involved in this effort. She stated her preference would be to allow the Assistant County Manager for Human Services to be the convener. Commissioner Jordan offered an amendment to section 2A of the proposed resolution to include that the Alliance be convened by the Assistant County Manager for Human Services. Chairwoman Sosa stated she would accept Commissioner Jordan’s amendment and would include an amendment allowing the County Attorney’s Office to serve as counsel to the Alliance. The forgoing proposed resolution was forwarded to the BCC with a favorable recommendation with Committee amendment(s) to include that the following language be added to Section 2(a) of this resolution: “the Alliance shall forward recommendations to the County Manager and the County Manager may incorporate said recommendations into a plan that will be developed pursuant to Resolution 1086-05;” that in section (a) Creation of the Alliance, the following organizations be added: The Children’s Trust, The Advocate Program, Children’s Psychiatric Center, Our Kids Inc., and Kristy House; that the language referenced in the resolution as “School Board or Public School systems” be substituted with the language “School Systems and Day Care Centers;” that the Office of the Children’s Advocate be added to Section 2(d); that the following language be added to section 2(f): “within the Department of Human Services or other community based organizations;” that where the resolution required the County Manager to report within 90 days be changed to 120 days; that the creation of the alliance be convened by the Assistant County Manager for Human Services working in conjunction with the Children’s Advocate Office and that the County Attorney’s Office may serve as counsel to the Alliance.

TITLE
RESOLUTION DIRECTING THE COUNTY MANAGER TO DEVELOP A DOMESTIC VIOLENCE PLAN FOR CHILDREN THAT ASSISTS CHILDREN IMPACTED BY DOMESTIC VIOLENCE AND RAISES AWARENESS ABOUT THE AFFECTS OF DOMESTIC VIOLENCE ON CHILDREN

BODY
WHEREAS, domestic violence is a destructive and far-reaching social problem that impacts every segment of the community, particularly children; and
WHEREAS, children do not have to be physically or verbally abused to be hurt by domestic violence; and
WHEREAS, children who witness or are exposed to domestic violence are at greater risk of physical assault and behavioral, social, emotional, and cognitive problems which can create a cycle of violence that spans generations; and
WHEREAS, children impacted by domestic violence experience higher levels of aggression, anxiety, and depression; and also suffer from low self-esteem, poor school performance, and limited problem solving skills; and
WHEREAS, many children who witness domestic violence or are exposed to domestic violence go undetected because domestic violence remains a well-guarded family secret in many households; and
WHEREAS, this Board seeks to create and implement a Domestic Violence Plan for Children that increases public awareness of domestic violence and the negative impact that it has on children and provides increased services to children affected; and

WHEREAS, this Board also desires to collaborate with the Miami-Dade County School System and the Miami-Dade County Children's Trust ("Children's Trust") to educate children about domestic violence and anger management,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA:
Section 1. The County Manager is directed to develop a Domestic Violence Plan for Children that will assist children impacted by domestic violence, raise awareness about the affects of domestic violence on children and educate children about domestic violence.
Section 2. The Plan shall include, but shall not be limited to, the following:
(a) Creation of an alliance, convened by the County Manager, consisting of children's advocates and representatives from various entities. The advocates and representatives may be selected from the following entities: State Attorney's Office of the 11th Judicial Circuit, The Miami-Dade County Police Department and Department of Human Services, Miami-Dade County School Board, Domestic Violence Oversight Board, Safe Space Foundation, University of Miami's Linda Ray Intervention Center, Advocate Program, Our Kids, Inc., Kristi House, Children's Psychiatric Center, Children's Trust, and a community based organization dedicated to child abuse prevention. The Alliance shall forward its recommendations to the County Manager and the County Manager may incorporate said recommendations into a separate plan that will be developed pursuant to Resolution R-1086-05, sponsored by Chairman Joe A. Martinez and adopted by the Board, directing the County Manager to implement recommendations from the July 2005 Victims Services Proposal relating to the coordination of services for victims of crime.
(b) Development of age appropriate programs by the Department of Human Services and the Children's Trust to educate children about domestic violence and anger management including, but not limited to, skits, puppet shows, panel discussions, workshops and teen dating sessions.
(c) Creation of a partnership between the Department of Human Services, Miami-Dade County school systems, daycare facilities and the Children's Trust to incorporate said domestic violence programs into the school curriculums and provide increased student counseling and teacher training.
(d) Development of a community-wide public awareness media campaign about the impact of domestic violence on children and available resources. The campaign shall include, without limitation, public service announcements in the print media and on Miami-Dade TV; advertisements and announcements in County facilities, on County property and on the County website; and modification of the Department of Human Services and the Office of the Child Advocate websites to include specific information on the impact of domestic violence on children and available services.
(e) The provision of additional services for children residing at County shelters and housing facilities including, but not limited to, additional individual and group therapeutic counseling services and the establishment of a funded budget for emergency, educational and recreational needs of children who are residing at County shelters or facilities.
(f) Designation of social workers or child advocates within the Department of Human Services or from a community based organization to assess the needs of children immediately after a domestic violence incident.
(g) Development of a Miami-Dade Police Department protocol for responding to domestic violence crime scenes when children are present including, but not limited to, notifying social workers or child advocates, with experience in the area of domestic violence, to assist the victim and his or her children and documenting details about any children present.
(h) Training of Miami-Dade Police Department officers to better prepare them for responding to domestic violence incidents that impact children and incidents involving the mentally ill.
Section 3. Within 120 days of the effective date of this Resolution, the County Manager shall submit a written report to the Community Outreach, Safety & Health Administration Committee detailing the County's Domestic Violence Plan for Children and implementation schedule. Following Committee consideration and acceptance of the Plan, the Plan shall be submitted to the Board for approval.
