REPORT: Assistant County Attorney Daron Fitch read the foregoing proposed resolution into the record. Chairwoman Sosa noted this resolution would establish the fund and waive the formal bid process for purchases not exceeding $10,000. She suggested this Committee send a message that the Miami-Dade Police Department (MDPD), not an outside entity, should manage this fund. Commissioner Jordan directed a question to Assistant County Manager Susanne Torriente regarding the soliciting of three or more quotes and the standards for administering other trust funds. Assistant County Manager Torriente responded, noting that by waiving the Administrative Order, a solicitation of quotes was no longer required. She stated she would ensure MDPD’s involvement in managing the expenditures. Commissioner Jordan asked for an amendment providing that the standard for this trust fund be consistent with the standard for other trust funds by either requiring two to three quotes or waiving the process. Chairwoman Sosa requested a report indicating how other trust funds were established before this resolution was considered by the County Commission. The forgoing proposed resolution was forwarded to the BCC with a favorable recommendation with Committee amendment(s) to include that the Miami Dade Police Department manage these funds and that the standard requirement for the bid and purchase procedure for this Trust Fund be consistent with the standards of other trust funds.

TITLE
RESOLUTION DIRECTING COUNTY MANAGER TO ESTABLISH FRIENDS OF MIAMI-DADE POLICE EXPLORER OUTREACH PROGRAM TRUST FUND TO RECEIVE MONIES AND MAKE APPROPRIATE EXPENDITURES FOR PURCHASE OF SERVICES, COMMODITIES AND FOOD IN CONNECTION WITH POLICE EXPLORER ACTIVITIES; AND WAIVING ADMINISTRATIVE ORDER 3-38 WITH RESPECT TO SMALL PURCHASE ORDERS

BODY
WHEREAS, Miami-Dade Police Explorer Outreach Program helps forge private/public sector partnerships for the benefit of the Miami-Dade County community and currently consists of 200 police explorers and 24 volunteer civilian advisors in seven posts established throughout Miami-Dade County; and
WHEREAS, police explorers provide assistance to county sponsored programs such as mock trials, events at the Miami-Dade County MetroZoo and annual police memorial events as well as community sponsored events such as Relay for Life through the American Red Cross; and
WHEREAS, this Board wishes to create the “Friends of the Miami-Dade Police Explorer Outreach Program Trust Fund” (“Trust Fund”) to be administered by the Miami-Dade Police Department for the purpose of establishing a trust fund for the deposit of private sector monetary and in-kind tax deductible contributions as well as public sector contributions in support of the Miami-Dade County Police Explorers Outreach Program; and
WHEREAS, the monies deposited in the Trust Fund shall be used to purchase supplies, food, and services related solely to their activities in carrying out the goals and objectives of the Miami-Dade County Police Explorers Outreach Program; and
WHEREAS, the Board wishes to waive the County’s formal bid and purchasing procedures in Administrative Order 3-38 with respect to small purchase orders in order to allow the Police Explorers to purchase supplies, food, and services in a timely manner in order to fulfill their goals, provided, each individual purchase does not exceed $10,000 and three quotes on the proposed purchase is obtained, if practicable or economically feasible,
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONER OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. The County Manager is directed to establish the “Friends of the Miami-Dade Police Explorer Outreach Program Trust Fund” to be administered by the Miami-Dade Police Department for the purpose of accepting private sector monetary and in-kind tax deductible contributions as well as public sector contributions in support of the Miami-Dade County Police Explorers Outreach Program.
Section 2. The County’s formal bid and purchasing procedures in Administrative Order 3-38 with respect to small purchase orders are waived for purchases by the Police Explorers of supplies, food and services related solely to their activities in carrying out the objectives of the Miami-Dade County Police Explorers Outreach Program, provided each individual purchase does not exceed $10,000 and three quotes on the proposed purchase is obtained, if practicable or economically feasible.
