Commissioner Heyman explained the intent of the foregoing resolution was to set a threshold of $2,000 for the County Manager to execute agreements without prior County Commission approval in an effort to neutralize processing costs.
Chairman Martinez noted the memorandum stated $2,000,000 rather than $2,000. He asked if this proposal allowed the County Manager to execute agreements to apply for, receive and expend funds without the BCC’s input or approval.
Commissioner Heyman noted the $2,000,000 amount was a scrivener’s error and should be corrected to read $2,000.
Assistant County Attorney Robert Cuevas noted the intent of the resolution was limited strictly to applying for and executing a grant, with ratification by the BCC, but there would be no authority to receive and expend without the BCC’s approval. He noted this resolution would give the County Manager the authority to proceed within a specified threshold.
Commissioner Gimenez requested that in the future, the requested amount be included in the title of any legislation authorizing the County Manager to apply for and expend grant funding.
Following discussion, the Board adopted the foregoing proposed resolution as amended to reflect the amount of funds provided under the grant is less than $2,000 in lieu of $2,000,000.
RESOLUTION DELEGATING AUTHORITY TO COUNTY MANAGER TO APPLY FOR AND ACCEPT CERTAIN GRANTS AND EXECUTE AGREEMENTS THEREFOR WITHOUT PRIOR COUNTY COMMISSION APPROVAL
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that the County Manager is hereby delegated authority to apply for, accept and execute grants on the County’s behalf without prior County Commission approval provided that: 1) the amount of funds provided under the grant is less than $2,000; 2) the grant is for a single department; 3) the grant does not require the provision of a new funds to match the grant funds; 4) the terms of the grant will not hinder another department or the County from seeking other funds; and 5) the granting agency does not require County Commission approval. The County Manager shall periodically submit grant agreements executed under the authority of this resolution to this Board for ratification.
