REPORT: Assistant County Attorney Maldonado read the foregoing resolution into the record. Commissioners Gimenez, Moss, and Edmonson requested to be listed as co-sponsors of the foregoing resolution. Chairwoman Heyman asked Assistant County Attorney Maldonado to prepare appropriate memoranda requesting that Chairman Martinez waive the Board’s Rules and Procedures and to allow this proposed resolution to be placed on the December 19, 2006 agenda. There being no further discussion or comments, the Committee proceeded to vote.

TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE, THE FLORIDA DEPARTMENT OF TRANSPORTATION, FLORIDA'S TURNPIKE ENTERPRISE, THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT AND OTHER PERTINENT STATE DEPARTMENTS TO FUND AND INSTALL GUARDRAILS ON HIGHWAYS ADJOINING CANALS AND OTHER WATERWAYS IN HEAVILY-TRAVELED AREAS AND IN EXPRESSWAY MEDIANS

BODY
WHEREAS, many highways and roads in Florida run parallel to canals and other waterways; and
WHEREAS, tragic accidents have occurred when drivers leave these highways and roads and enter the waterways; and
WHEREAS, the installation of guardrails could prevent many such accidents; and
WHEREAS, the benefits of guardrails particularly along heavily-traveled highways and roads outweighs the cost of installation,
WHEREAS, during the 2006 session, the Florida House and Senate passed HB 959 sponsored by Representative Yolly Roberson and Senator Larcenia Bullard (SB 1022) that would have created a pilot program in Miami-Dade County to install guardrails along interstate and other limited access highways that are adjacent to canals and other waterways, but the Governor vetoed HB 959,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:

Section 1. Urges the Florida Legislature, the Florida Department of Transportation, Florida's Turnpike Enterprise, the South Florida Water Management District, and other pertinent state departments to install guardrails on highways and roads running parallel to canals and other waterways, particularly along heavily-traveled routes and in expressway medians.
Section 2. Directs the Clerk of the Board to transmit copies of this resolution to the Governor, the Senate President, the House Speaker, the Chair and members of the Miami-Dade State Legislative Delegation, the Secretary of the Florida Department of Transportation, the executive director of Florida's Turnpike Enterprise, and the executive director of the South Florida Water Management District.
Section 3. Directs the County's state lobbying team to advocate for the passage of legislation and the changes in policy set forth in Section 1 above. The Office of Intergovernmental Affairs is directed to include this item in the 2007 State Legislative Package.
