TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE TO PASS LEGISLATION REMOVING THE CAP ON THE STATE HOUSING TRUST FUND

BODY
WHEREAS, low and moderate income families in Miami-Dade County and across the State of Florida are finding it difficult to obtain affordable rental and single family housing due to dramatic increases in housing costs coupled with modest rises in incomes; and
WHEREAS, federal housing programs, especially those that typically serve individuals with the lowest incomes, have experienced significant budget reductions in recent years, placing increasing pressure on state and local governments to provide housing assistance; and
WHEREAS, the State of Florida receives documentary stamp tax revenues that are deposited into the State Housing Trust Fund and the Local Government Housing Trust Fund for the purpose of funding affordable housing; and
WHEREAS, because documentary stamp tax revenues are tied to deeds and mortgages, these revenues have increased significantly in recent years as Florida’s real estate market has experienced a high level of growth, exceeding $478 million in fiscal year 2004-05 and exceeding $448 million in fiscal year 2005-06; and
WHEREAS, during the 2005 state legislative session, the Florida Legislature passed Chapter 2005-92, Laws of Florida (HB 1889), which among other things, capped at $243 million the amount of documentary stamp tax revenues cap that could be distributed to the State Housing Trust Fund and the Local Government Housing Trust Fund and diverting the remaining revenues to the state general fund effective July 1, 2007; and

WHEREAS, while the Florida Legislature passed comprehensive affordable housing legislation during the 2006 state legislative session, the final bill did not include a provision that would eliminate the $243 million cap on documentary stamp tax revenue for affordable housing set to go into effect on July 1, 2007; and
WHEREAS, capping the amount of funds that are deposited into the State Housing Trust Fund and the Local Government Housing Trust Fund for affordable housing will negatively impact the creation and availability of much needed affordable housing within Miami-Dade County as well as throughout the State; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges the Florida Legislature to pass legislation removing the cap on documentary stamp tax revenues scheduled to take affect on July 1, 2007, on the amount of proceeds which may be deposited into the State Housing Trust Fund and the Local Government Housing Trust Fund.
Section 2. Directs the Clerk of the Board to transmit a certified copy of this resolution to the Governor, the Senate President, the House Speaker, Representative Mike Davis, and the Chair and members of the Miami-Dade County State Legislative Delegation.
Section 3. Directs the County's state lobbyists to advocate for the passage of the legislation set forth in Section 1 above, and directs the Office of Intergovernmental Affairs to include this item in the 2007 State Legislative Package.
