REPORT: Commissioner Moss explained the intent of the foregoing proposed resolution. Chairman Martinez asked to be listed as a cosponsor on the foregoing proposed resolution. He noted he reissued a letter previously sent to the Florida Legislature regarding the same subject matter outlined in this proposed resolution. In addition, he noted he had not received a response to the letter. County Attorney Murray Greenberg stated following the adoption of the foregoing proposed resolution, staff would research how the County could proceed and present a recommendation for the Board’s approval. Commissioner Diaz asked to be listed as a cosponsor on the foregoing proposed resolution. He requested his colleagues to attend during the Florida Legislature’s special session to address the property insurance relief to the citizens of Miami-Dade County. Commissioner Gimenez asked the County Attorney and the County Manager to provide a report in 60 days prior to the legislature special session to determine the feasibility of all possible actions including discrimination which might be taken against property insurance companies for Florida citizens. Chairman Martinez asked for the distribution of the report requested by Commissioner Gimenez to all Board members. Following Commissioner Sorenson’s inquiry regarding if the Board members should go to Tallahassee prior to the legislative session, Assistant County Attorney Jess McCarty noted the House and Senate staff were currently working on this bill and anticipated the two weeks prior to the special session would be the time to meet with legislature. He noted during the special session the Legislature would announce the results of this bill. Chairman Martinez asked Assistant County Attorney Jess McCarty, in coordination with County Attorney Murray Greenberg, to provide to Board members a schedule of the Florida Legislative committees that would hear the issue regarding property insurance relief as soon as possible. Following Chairman Martinez’ comments regarding scheduling a special meeting to discuss this issue, Commissioner Barreiro, the newly elected Board of County Commission Chair, noted he was working on scheduling a meeting possibility the week of January 8th. Commissioner Moss stated he supported the organizing and the scheduling of meetings with the Florida Legislature to discuss the foregoing issue outlined in the proposed resolution. Responding to Commissioner Moss’ inquiry regarding if an opportunity would be given for public participation during the special session, Assistant County Attorney McCarty stated there would probably be an opportunity for public input during the special session; however, this would be after the fact and the enactment of the Bill. Commissioner Barreiro noted the House and Senate Committees was the key for public participation. Mr. Ramon Rasco, Director, Office of Intergovernmental Affairs, informed the Board that on January 4, 2007, at the Miami-Dade College North Campus, the Miami-Dade County State Legislative Delegation had scheduled a forum to allow local governmental agencies to present their legislative agenda as it pertained to property insurance relief to the citizens of Miami-Dade County. Hearing no further questions or comments, the Board adopted the foregoing proposed resolution as amended to direct the County Manager and the County Attorney to provide a report to the Board before the start of the Florida Legislature’s special session to address the property insurance crisis on January 16, 2007.

TITLE
RESOLUTION DIRECTING COUNTY MANAGER AND COUNTY ATTORNEY TO DETERMINE THE FEASIBILITY OF ALL POSSIBLE ACTIONS WHICH CAN BE UNDERTAKEN TO PROVIDE PROPERTY INSURANCE RELIEF TO THE CITIZENS OF MIAMI-DADE COUNTY, FLORIDA

BODY
WHEREAS, property insurance rates for Florida citizens have gone unchecked over recent years and in the last year have reached unconscionable proportions; and
WHEREAS, it is the role of government to be of assistance to its citizens when they are unable to act individually; and
WHEREAS, no action has been undertaken by either private insurance companies or the State to curb these outrageous increases in property insurance rates,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that the County Manager and the County Attorney are hereby directed to determine all possible administrative and legal actions which may be taken against property insurance companies and the State to compel the reduction of annual premiums for property insurance and report such actions to the Board before the start of the Florida Legislature's special session to address the property insurance crisis on January 16, 2007.
