REPORT: Assistant County Attorney Benitez read the foregoing resolution into the record. It was moved by Commissioner Gimenez that this proposed resolution be forwarded to the Board of County Commissioners with a favorable recommendation. This motion was seconded by Commissioner Sorenson. Commissioner Gimenez asked that he be listed as a co-sponsor. In response to Commissioner Gimenez, Assistant County Attorney Benitez explained that restaurants were inspected by the State pursuant to Section 509.032 of the Florida Statues. Hearing no other questions or comments, the Committee proceeded to vote.

TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE TO IMPOSE A LETTER-GRADING SYSTEM FOR RESTAURANT INSPECTION REPORTS AND TO REQUIRE RESTAURANTS TO POST SUCH LETTER GRADE ON A SIGN NEAR THE ENTRANCE INDICATING THAT THE INSPECTION REPORTS ARE AVAILABLE FOR PUBLIC REVIEW

BODY
WHEREAS, the State of Florida currently has exclusive jurisdiction to inspect restaurants for health and cleanliness standards and Section 509.101, Florida Statutes, provides that inspection reports must be made available upon request for public review; and
WHEREAS, a recent local television news report found that a number of restaurants in Miami-Dade County do not comply with the law requiring them to provide such inspection reports to the public upon request; and
WHEREAS, Florida law currently does not require restaurants to post signs indicating to the public that inspection reports are available for public review, and Florida law preempts local governments from imposing such a requirement; and
WHEREAS, the State of California requires that restaurants post signs indicating that health inspection reports are available for public review; and
WHEREAS, the States of North Carolina and Tennessee not only require restaurants to post such signs, but also impose a letter grade on restaurants that must be shown on the sign indicating how well the restaurant has scored on the health inspection,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges the Florida Legislature to impose a letter-grading system for restaurant inspection reports and to require restaurants to post such letter grade on a sign near the entrance indicating that the inspection reports are available for public review.
Section 2. Directs the Clerk of the Board to transmit certified copies of the resolution to the Governor, Senate President, House Speaker, and Chair and members of the Miami-Dade State Legislative Delegation.
Section 3. Directs the County's state lobbyists to advocate for the issue identified in section 1 above, and directs the Office of Intergovernmental Affairs to include this item in the 2007 state legislative package.
