REPORT: | County Attorney Murray Greenberg read the foregoing proposed resolution into the record. Chairman Barreiro opened the public hearing. Hearing no one wishing to speak before the Board, Chairman Barreiro closed the public hearing. The Board proceeded to vote on the foregoing proposed resolution as presented. Commissioner Jordan expressed concern with a proliferation of performing arts centers moving forward. She stated the County continuously chastised its own Performing Arts Center (PAC) for not being able to generate revenue to sustain itself, yet the Board continued to provide more competition with the PAC by allocating funds to support community performing art centers. | ||||||

REPORT: | The foregoing proposed resolution was read into the record by Assistant County Attorney Joni Armstrong-Coffey. Chairwoman Seijas expressed concern regarding the City of Aventura’s proposal to construct a 300-seat Performing Art Center (PAC) in lieu of preserving green space. Mr. Roger Hernstadt, Director, Office of Capital Improvements, clarified the City of Aventura originally contemplated purchasing land to build the proposed PAC but the City had decided to use the funding to construct this facility on County-owned property, simultaneously with the construction of the County Library. Honorable Mayor Susan Gottlieb, City of Aventura, appeared in support of the foregoing resolution. She expressed appreciation to the Committee members for their support and for entering into this joint venture with the City, which would be a great opportunity for both the City of Aventura and the County. | ||||||

TITLE RESOLUTION APPROVING SIGNIFICANT MODIFICATION TO BUILDING BETTER COMMUNITIES BOND PROGRAM PROJECT NO. 57-AVENTURA-PURCHASE LAND FOR PARKS/PUBLIC FACILITIES IDENTIFIED IN APPENDIX A TO RESOLUTION NO. R-913-04 AFTER A PUBLIC HEARING BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by this reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby approves the significant modification to Building Better Communities Bond Program Project No. 57-�Aventura-Purchase Land for Parks/Public Facilities� identified in Appendix A to Resolution No. R-913-04 after a public hearing, all as more particularly described in the accompanying memorandum. Burgess County Manager Subject: Significant Modification of Building Better Communities Bond Program Project No. 57 � �Aventura � Purchase Land for Parks/Public Facilities� STAFF RECOMMENDATION It is recommended that the Board of County Commissioners (Board) adopt the attached resolution which approves significant modifications to the Building Better Communities (BBC) bond program project description for the �Aventura � Purchase land for Parks/Public Facilities� � Project No. 57 after a public hearing pursuant to Resolution No. R-913-04 (�Authorizing Resolution�). Scope The impact of this agenda item is limited to County Commission District 4 and the City of Aventura. Fiscal Impact/Funding Source There is no fiscal impact on the existing BBC allocation due to this modification and the project is funded from the Building Better Communities Bond Program. Track Record/Monitor Recommending Entity � The implementing agency will be the City of Aventura which is in good standing with Miami-Dade County. The responsible party for Monitoring is the Office of Capital Improvements (OCI), Roger T. Hernstadt, Director. The Project Manager from OCI will be Jose A. Galan, Chief � Program Legislation. MANAGER'S BACKGROUND Appendix A to the Authorizing Resolution lists municipal projects eligible for funding from the Building Better Communities Bond Program by number, name and size. All additions, deletions and significant modifications to individual projects or to Appendix A require a majority vote of the Board after a public hearing. One of the municipal projects included in the Building Better Communities Bond Program as Project No. 57 is �The purchase of a park/facility in the City of Aventura� with an allocation of $4.714 million. The original description for this project, as included in Resolution No. R-913-04 states: �GOB funds will compliment other funding to purchase vacant land in the City of Aventura to be used for parks or other public facilities.� The Office of Capital Improvements has worked with the City of Aventura to develop a strategic approach for maximizing the public benefits of their bond program funding. As a result of this work, it is recommended that the project description be modified to allow for the design and construction of a Performing Arts Center in lieu of the purchase of vacant land for parks or other public facility. The new description will be as follows: �GOB funds will complement other funding to buy land and/or provide funding for design and construction costs of a Performing Arts Center that will house approximately 300 seats and provide a variety of performing arts and cultural programming for all age groups. The project will be built on County land alongside or above the Aventura Branch Library that is being rebuilt after it was destroyed by Hurricane Wilma.� The City of Aventura intends to construct this project on County land that currently houses the Northeast Library. This library was damaged beyond repair by Hurricane Wilma in 2006 and the Library Department has worked with the City of Aventura to prepare an interlocal agreement allowing the City to build the library on our behalf. When completed, the new complex will house both a Performing Arts Center and a new library. To facilitate this, an item that would allow municipalities to use their own procurement procedures when constructing projects on behalf of the County has been submitted and will soon appear before the Board for consideration. The proposed ordinance stipulates that the County�s Community Small Business Enterprise (CSBE) and Community Business Enterprise (CBE � A/E) programs would remain in effect. In addition, an inter-local agreement with the City of Aventura is also being scheduled for Board consideration under separate cover. _________________________________ Assistant County Manager |
