REPORT: Chairman Rolle relinquished the chair to Commissioner Jordan, and noted that he hoped the foregoing resolution would bring up concerns regarding the status of the Disadvantage Business Enterprise (DBE). Commissioner Sorenson suggested during the examination of the proposed budget for FY 2007-08, that the Board consider a monitoring compliance for other programs such as Community Small Business Enterprise (CSBE) and Living Wage. Commissioner Edmonson asked to be listed as a co-sponsor of this foregoing resolution. Hearing no further questions or comments, the Committee proceeded to vote.

TITLE
RESOLUTION DIRECTING THE COUNTY MANAGER TO REPORT ON THE STATUS OF COMPLIANCE WITH THE DISADVANTAGED BUSINESS ENTERPRISE (DBE) MEASURES ON CONTRACTS AWARDED WITHIN THE LAST THREE YEARS; AND DIRECTING THE COUNTY MANAGER TO REPORT ON COMPLIANCE WITH THE PROMPT PAYMENT PROVISIONS AS OUTLINED IN THE CODE OF MIAMI-DADE COUNTY AND THE SUBJECT CONTRACT

BODY
WHEREAS, a federally approved DBE program is a requirement for many federally funded projects; and
WHEREAS, upon entering contracts with Miami-Dade County, contractors oftentimes commit to meeting DBE goals; and
WHEREAS, Miami-Dade County has already spent hundreds of millions of dollars in contracts with DBE measures; and
WHEREAS, DBE firms, as smaller businesses, are especially dependent upon the prompt payment on invoices for work performed,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board directs the County Manager to report to the Transit Committee within 60 days on the status of DBE compliance as to all contracts awarded within the last three years. This Board further directs the County Manager to report on whether the prompt payment provisions of the contracts and the Code of Miami-Dade County have been complied with. The report should also include, to the extent there have been instances of non-compliance with the prompt payment provisions, what measures have been and/or will be taken in order to ensure future compliance.
