REPORT: Assistant County Attorney Cynthia Johnson-Stacks read the following proposed amendments to the foregoing proposed resolution as follows: (1) to increase the Affordable Housing Advisory Board (AHAB) membership to 17 in lieu of 15 that would increase the number of members to be appointed by the Board of County Commission to 15 instead of 13, (2) to indicate the AHAB appointment by the County Mayor and the Overall Tenant Advisory Council would not be vacated as outlined in this resolution and not subject to the application and the nomination ballot process, (3) to require the Board to collectively appoint the AHAB members by a ballot vote, and (4) to insert language to this resolution and on the application to be developed by staff that those interested in serving on the AHAB to indicate any potential conflict in serving on the AHAB. Hearing no objection, the Committee forwarded the foregoing proposed resolution as amended by Assistant County Attorney Johnson-Stacks. TITLE
RESOLUTION VACATING COMMISSION APPOINTMENTS OF CURRENT AFFORDABLE HOUSING ADVISORY BOARD MEMBERS, IMPLEMENTING A NEW APPLICATION AND APPOINTMENT PROCESS WHEREBY THE ENTIRE BOARD OF COUNTY COMMISSIONERS IS CHARGED WITH APPOINTING NEW MEMBERS TO THE AHAB BOARD BY A BALLOT VOTE, FOLLOWING SUBMISSION OF NOMINATIONS BY INDIVIDUAL COMMISSIONERS

BODY
WHEREAS, pursuant to the William E. Sadowski Affordable Housing Act ("Sadowski Act") this Board adopted Section 17-106 of the Code creating the Affordable Housing Advisory Board (AHAB), and setting forth AHAB's membership, composition, terms of office, qualifications, organization and procedure, applicability of County rules and procedures, powers and duties, reporting requirements and staff support; and
WHEREAS, AHAB serves as the County's affordable housing committee and consists of seventeen (17) members, fifteen (15) of which are appointed by the Board of County Commissioners (BCC), one (1) is appointed by the Mayor, and one (1) is appointed by the Overall Tenant Advisory Council; and
WHEREAS, simultaneously with this Resolution this Board is amending the AHAB ordinance in an effort to maintain and strengthen the public's confidence in the AHAB Board by preventing those who are connected to entities that receive AHAB funding from serving on the board and making other necessary changes; and

WHEREAS, this Board desires to maintain the integrity of the structure of the AHAB, in light of its recommendations to this Board; and
WHEREAS, in order to attain these goals this Board shall vacate its appointments to the current AHAB Board and, within sixty (60) days from the date of this Resolution, appoint the new members of the AHAB as an entire Board, discontinuing the current practice of having individual Commissioners nominate and appoint members to the AHAB; and
WHEREAS, this Board shall require all those interested in serving on the AHAB to submit applications, which staff will develop, that will inform this Board of each applicant's qualifications and any potential conflict issues,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board :
Section 1. Vacates the current membership of the AHAB appointed by Commissioners.
Section 2. Directs staff to develop an application for individuals who desire to be appointed by the Commission to serve on the AHAB. At a minimum said application shall request each applicant to disclose any potential conflict of interest issues.
Section 3. Changes the appointment process from individual Commissioner appointments to requiring the entire Board to collectively, by ballot, appoint the requisite AHAB members, as outlined in 420.9076(2), Fla. Stat, following nominations by individual Commissioners; provided, however, that the application and ballot processes established by this resolution shall not apply to the appointments made by the Mayor and the Overall Tenant Advisory Council (OTAC).
