REPORT: | Commissioner Moss asked to be added as a co-sponsor to the foregoing resolution. Commissioner Jordan expressed concern regarding County owned facilities being patrolled by Miami-Dade County’s Police officers and inquired whether ensuring that this happened was possible. County Attorney Cuevas advised that the City of Miami conveyed a portion of the American Airlines Arena (AAA) site to the County with a condition that required City of Miami Police officers to patrol the AAA during events. He pointed out that in the future each County owned site could negotiate the police services issue, however, to unilaterally change this presented a problem. Commissioner Gimenez stated that he supported the foregoing proposed resolution. | ||||||

RESOLUTION NO. ________________________ RESOLUTION REQUIRING THE HIRING OF COUNTY POLICE OFFICERS AND FIREFIGHTERS TO PERFORM OFF-DUTY ASSIGNMENTS AT COUNTY OWNED FACILITIES WHEREAS, Section 2-56 of the Code of Miami-Dade County authorizes police officers and firefighters to engage in off-duty employment under certain conditions; and WHEREAS, events conducted at County owned facilities regularly require the use of off-duty police and firefighters; and WHEREAS, this Board wishes to ensure that the County�s own officers and firefighters are used at County owned facilities; and WHEREAS, this Board recognizes its obligation to honor any existing contract or other legal obligations it may have regarding the use of off-duty police officers and firefighters, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that whenever off-duty police officers or firefighters are hired to serve at an event taking place at a County owned facility, including officers hired to maintain or provide internal or external event security and/or traffic control relating to the event, they shall be County police officers or firefighters hired in accordance with the provisions of ��2-56 of the Miami-Dade County Code. This requirement shall not apply to any event at a County owned facility conducted pursuant to or under the authority of a lease, management or interlocal agreement with the County which pre-exists this resolution and which presently requires the use of non-County police or fire personnel. The Mayor and Manager shall include provisions consistent with this resolution in all future contracts, leases and other agreements, including the management agreement to be entered into between the County and the Marlins Stadium Manager. The foregoing resolution was sponsored by Commissioner Jose �Pepe� Diaz and offered by Commissioner , who moved its adoption. The motion was seconded by Commissioner and upon being put to a vote, the vote was as follows: Bruno A. Barreiro, Chairman Barbara J. Jordan, Vice-Chairwoman Jose "Pepe" Diaz Audrey M. Souto The Chairperson thereupon declared the resolution duly passed and adopted this 4th day of March, 2008. This resolution shall become effective ten (10) days after the date of its adoption unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
