REPORT: Assistant County Attorney Jess McCarty read the foregoing proposed resolution into the record. Chairman Martinez asked Special Assistant to the County Manager Jennifer Glazer-Moon to provide him with a report on the fiscal impact of providing County employees with an additional one-hour of leave time for voting. Hearing no other questions or comments, the Committee proceeded to vote. Chairman Martinez asked staff to prepare the appropriate memorandum to the Board of County Commissioners' Chairman Bruno A. Barreiro requesting that the Board's Rules and Procedures be waived to allow the foregoing proposed resolution to be heard at the December 16, 2008 County Commission meeting.

TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE TO REQUIRE EMPLOYERS TO GIVE WORKERS TIME OFF TO VOTE

BODY
WHEREAS, while itís a felony under Florida law to fire or threaten to fire an employee for voting, Florida law does not require employers to provide employees time off to vote; and
WHEREAS, two-thirds of the states require public and private employers to provide employees time off to vote, while only 18 states including Florida do not require employers to give workers time off to vote; and
WHEREAS, while the amount of time for voting varies by state, states typically require employers to provide employees two (2) hours of leave time to vote; and
WHEREAS, requiring employers to give workers time off to vote combined with early voting would allow increased numbers of people in Florida to participate in elections,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges the Florida Legislature to require employers to give workers time off to vote.
Section 2. Directs the Clerk of the Board to transmit a certified copy of this resolution to the Governor, the Senate President, the House Speaker, the Chair and Members of the Miami-Dade County State Legislative Delegation, and the Florida Secretary of State.
Section 3. Directs the County's state lobbyists to advocate for the passage of the legislation set forth in Section 1 above, and directs the Office of Intergovernmental Affairs to include this item in the 2009 State Legislative Package.
