REPORT: Assistant County Attorney Jess McCarty read the foregoing proposed resolution into the record. Commissioner Martinez questioned the feasibility of the Committee instructing the Commission Auditor to include his legislative analysis as an attachment to each agenda item; and whether this proposed resolution would provide the Commission with a significant number of analyses, notwithstanding the exempted items in Section 2. Mr. Charles Anderson, Commission Auditor, noted the requirement in Section 1 was feasible, and this proposed resolution would have a significant impact, notwithstanding the exemptions. Commissioner Gimenez requested this proposed resolution be amended to require the legislative analysis prepared by the Commission Auditor to include the date he received the agenda item from the County Administration. Commissioner Jordan pointed out the title to an agenda item sometimes appeared on the agenda, however, the agenda package was not provided until the last minute. Commissioner Gimenez noted the County Commission needed to take appropriate steps to ensure the Office of the Commission Auditor acquired the institutional knowledge needed to be prepared for comprehensive changes in the County Administration in the event a new mayor was elected. Hearing no other questions or comments, the Committee proceeded to vote on this proposed resolution as amended to require the legislative analysis prepared by the Commission Auditor to include the date that the Commission Auditor received the agenda item from the County Administration.

TITLE
RESOLUTION DIRECTING COMMISSION AUDITOR TO INCLUDE WITH EACH AGENDA ITEM PLACED ON THE AGENDA A COPY OF LEGISLATIVE ANALYSIS FOR THAT PARTICULAR ITEM

BODY
WHEREAS, the Commission Auditor is charged with, among other duties, the responsibility of determining whether the fiscal and legislative policies of the County Commission are being faithfully, efficiently and effectively implemented by County personnel, and whether they are achieving their desired objectives; and
WHEREAS, the Commission Auditor is also charged with, among other duties, the responsibility of preparing legislative analysis for agenda items considered by the County Commission; and
WHEREAS, the Commission Auditor currently produces a single document which contains the legislative analysis for all items to be considered at a particular commission or committee meeting; and
WHEREAS, the Commission believes that the legislative analysis prepared by the Commission Auditor for a particular item will be more useful if it is included with that particular agenda item when placed on the agenda,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:

Section 1. The Commission Auditor shall include with each agenda item placed on the agenda a copy of the legislative analysis prepared by the Commission Auditor >>which shall include, among other things, the date when the item was received by the Commission Auditor<<.1
Section 2. The provisions of this resolution shall not apply to: (1) items for which legislative analysis is not ordinarily prepared; (2) ordinances placed on the final agenda for first reading; (3) items submitted where the four-day rule is applicable; (4) resolutions exempt from committee review; and (5) resolutions where the Commission Auditor does not have sufficient time to prepare the legislative analysis prior to the print date for the applicable committee or commission meeting.
