TITLE RESOLUTION URGING FLORIDA LEGISLATURE AND THE FLORIDA PUBLIC SERVICE COMMISSION TO ENACT LEGISLATION OR RULES REQUIRING ELECTRIC UTILITIES TO REACTIVATE A CUSTOMER�S ELECTRIC SERVICE DISCONNECTED FOR NON-PAYMENT WITHIN TWELVE HOURS OF CUSTOMER PAYING THE OUTSTANDING BALANCE OR OTHERWISE RESOLVING THE REASON FOR THE SERVICE BEING DISCONNECTED BODY WHEREAS, pursuant to Florida Administrative Code � 25-6.105 (the �Code�), an electric utility may discontinue service to a customer for non-payment of bills; and WHEREAS, service to a customer may only be discontinued after there has been a diligent attempt to have the customer comply, including at least five (5) working days� written notice to the customer, such notice being separate and apart from any bill for service; and WHEREAS, the Code requires that electric service be restored as soon as the reason for disconnection has been resolved; and WHEREAS, there is currently no Florida law requiring electric utilities to reactivate a customer�s electric service within a certain period of time of the customer paying the outstanding balance on his or her account or otherwise resolving the reason for the service being disconnected; and WHEREAS, the loss of electric power for extended periods of time can be detrimental to the health and welfare of customers and the community at large, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board: Section 1. Urges the Florida Legislature to enact legislation or the Public Service Commission to enact rules requiring electric utilities to restore a customer�s electric service disconnected for non-payment within no more than twelve (12) hours of the customer paying the outstanding balance on his or her account or otherwise resolving the reason for the service being disconnected. Section 2. Directs the Clerk of the Board to transmit certified copies of this resolution to the Governor, Senate President, House Speaker, the Chair and Members of the Miami-Dade State Legislative Delegation, and the Chair and Members of the Florida Public Service Commission. Section 3. Directs the County�s state lobbyists to advocate for the issue identified in Section 1 above, and directs that the 2010 state legislative package be amended to include this item. |
