REPORT: | Assistant County Attorney Gerald Sanchez read the foregoing proposed resolution into the record. Commissioner Sosa asked Assistant County Manager Alina Hudak to report on costs associated with the State Transparency Website; whether the State of Florida was providing any funding for the Website; and the legal remedies available to the County when presented with State mandated requirements without representation. There being no further questions or comments, the Committee proceeded to vote on the foregoing proposed resolution. | ||||||

TITLE RESOLUTION DIRECTING THE MAYOR OR DESIGNEE TO OBTAIN APPROVAL FROM THE BOARD OF COUNTY COMMISSIONERS PRIOR TO TAKING ANY POSITION RELATED TO SB 1796 AND THE IMPLEMENTATION OF A STATE TRANSPARENCY WEBSITE BODY WHEREAS, during the 2009 state legislative session, the Florida Legislature passed SB 1796, the Transparency Florida Act, which required the State of Florida to establish a website for public access to government financial information in Florida; and WHEREAS, the initial phase of the website required under SB 1796 consists of appropriations and expenditure data for all branches of state government; and WHEREAS, SB 1796 also tasked the Joint Legislative Auditing Committee (JLAC) with providing a proposal by March 1, 2010, to provide a phase-in schedule for the website related to other governmental entities in Florida, including local governments, community colleges, state universities, and other government entities that receive state appropriations; and WHEREAS, JLAC is currently in the process of surveying governmental entities about how they could provide financial information for inclusion in the statewide transparency website; and WHEREAS, JLAC will also be conducting workshops on how to implement SB 1796 related to local governments, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that: Section 1. Any position taken by Miami-Dade County related to SB 1796 or the implementation of a state transparency website shall be approved in advance by the Budget, Planning & Sustainability Committee and the Board of County Commissioners. Section 2. The Mayor or Designee shall provide an analysis and the Administration�s position related to SB 1796 at the Budget, Planning & Sustainability Committee at the regular September meeting of the Committee. Section 3. The Mayor or Designee shall keep the Board of County Commissioners informed of all meetings related to implementation of SB 1796 and the state transparency website. |
