REPORT: Assistant County Attorney Daniel Frastai noted an amendment to the foregoing proposed resolution to add the language: “as the two economic engines of Miami-Dade County both of which are currently undergoing capital expansion programs, Miami International Airport and the Port of Miami are excluded from the provisions of this resolution” at the end of the last paragraph on handwritten page 3, after the language which reads: “upon written request of the Mayor.” It was moved by Commissioner Sosa that the foregoing proposed resolution be adopted as amended with the language as read by Assistant County Attorney Frastai. This motion was seconded by Commissioner Martinez. Commissioner Sosa noted that expenditures for furniture were in excess of $22,000 per day based upon an average of the previous two years, excluding capital project purchases. She said that the elimination of furniture purchases would assist the County in balancing its budget. Commissioner Sosa responded to Commissioner Seijas’ inquiry pertaining to whether furniture purchases for the Children’s Courthouse if built, would be excluded from the General Fund. She noted at the appropriate time when the Courthouse was built, a waiver process existed for the Commission to approve specific needed items. Commissioner Sosa also responded to the request for information about the rationale for excluding both the Airport and the Seaport from this resolution. She explained that the Airport did not receive support from the General Fund and noted she was unaware of the reason for excluding the Seaport. County Manager George Burgess added that the Seaport was a self-supporting operation which derived its revenue from fees and did not receive support from the General Fund. He noted the majority of funding for its furnishings was included in either self-supporting operations or capital (bond) funded projects. Mr. Burgess noted that furniture necessary for construction projects were not taken from the operating budget. He noted that the budget for FY 2009-10 included approximately $1.9 million for furniture purchase from the operating budget and approximately $300,000 from the General Fund. Commissioner Jordan invoked the 4 Day Rule on this proposed resolution.

TITLE
RESOLUTION DIRECTING THE COUNTY MAYOR OR COUNTY MAYOR’S DESIGNEE TO CEASE THE PURCHASE OF FURNITURE BY COUNTY DEPARTMENTS FOR A PERIOD OF ONE YEAR FROM THE DATE OF ADOPTION OF THIS RESOLUTION

BODY
WHEREAS, Miami-Dade County is in the process of adopting a budget in the midst of an economic crisis; and
WHEREAS, the County has spent over 16 million dollars in the purchase of furniture during the first two years of the current contract for furniture purchases (See attached memorandum from the County Manager dated June 25, 2009); and
WHEREAS, this Board desires to reduce County expenditures as much as possible and eliminate the expenditure of unnecessary items,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board directs the County Mayor or County Mayor’s designee to cease the purchase of furniture by all County departments for a period of one year from the date of the adoption of this resolution. This resolution shall not authorize the breach of any current County contractual obligations. In the event that the purchase of furniture is necessary to provide an essential government service or a legally mandated service, or in the event that this Board determines that a specific situation may so warrant, this Board may waive the prohibitions of this resolution upon written request of the Mayor.
