REPORT: First Assistant County Attorney Abigail Price-Williams read the foregoing proposed ordinance into the record. Commissioner Sorenson noted this proposal set a bad precedent, allowing a non-agricultural use by right in an agricultural zoning district. She noted the BCC had already decided this use could be allowed through an action of the Comprehensive Development Master Plan; however, the BCC did not allow automatic compatibility with agriculture. Commissioner Sorenson said this was spot zoning, allowing the property owner to skip a zoning hearing and go through an administrative procedure instead. She noted specific language in the ordinance intended to restrict decision to the area in the C-9 basin; however, it sent a clear message that other non agricultural activities could be included in agricultural zoning districts without first obtaining zoning approval. It was moved by Commissioner Diaz that the foregoing proposed ordinance be adopted as amended to replace the language “the property line along rights-of way” with “all property lines” in the last line of the first paragraph on handwritten page 9. This motion was seconded by Commissioner Martinez, and upon being put to a vote, passed by a vote of 11-1, (Commissioner Sorenson voted “no”) (Commissioner Rolle was absent). The foregoing proposed ordinance was adopted as amended to replace the language “the property line along rights-of way” with “all property lines” in the last line of the first paragraph on handwritten page 9.
