REPORT: Assistant County Attorney Gerald Sanchez read the foregoing proposed resolution along with the accompanying report Agenda Item 7A, Legislative File No. 110091 into the record. Commissioner Heyman noted that this proposed resolution would establish a policy to allocate Fiscal Year (FY) 2009-10 unallocated general fund carryover to fund a Police Forensic Artist position for FY 2010-11 in an amount equal to $88,575.00. She noted her concern with other law enforcement agencies and municipalities and a potential breakdown in the services provided by the Miami-Dade Police Department (MDPD). She stressed the need to maintain working relationships with other law enforcement agencies that used the MDPD Forensic Art Unit (Unit). Commissioner Heyman informed the Committee members of the previous discussion before the Health, Public Safety and Intergovernmental Committee on December 16th. She noted at that meeting, Committee members agreed that they needed to be addressed immediately. She noted the fourth paragraph of the Manager’s memorandum dated November 30, 2010, indicated that the MDPD Unit would no longer provide lineup composite services to outside agencies. She also noted one staff person for this unit was unacceptable, and funding was available for two positions. Commissioner Heyman noted the need to collaborate with representatives from the Department of Homeland Security (DHS) who offered to pursue grants with MDPD but that offer was subsequently declined. She stated that the County provided over 100 service requests to DHS annually, and she had copies of correspondence from the Cities of Homestead and Doral; the City of Miami and other municipalities assisted by the MDPD Forensic Art Unit. It was moved Commissioner Heyman that the Committee forward this proposed resolution to the County Commission. This motion died due to the lack of a second. Assistant County Attorney Sanchez stated that this proposed resolution would be carried over to the next Committee meeting due to the lack of a second. He indicated that if it was not the intent of this Committee to consider the item at its next meeting, an appropriate motion should be made at this meeting. It was moved by Commissioner Heyman that the foregoing proposed resolution be forwarded to the County Commission. Commissioner Edmonson seconded this motion. Commissioner Edmonson noted a memorandum dated January 5th, 2011, addressed to Assistant County Manager Alina Hudak from MDPD Director Loftus entitled, “Police Forensic Art Unit Manpower Reduction.” She asked Mr. Loftus if he needed two positions for the Unit. Mr. Loftus stated he did not need two positions and that one person was sufficient for this Unit. He indicated that he would present a request to this Committee if the need arose for additional Unit staff in the future. Commissioner Bell noted she could not support the foregoing proposed resolution. She referred to the language in the third paragraph of the Manager’s memorandum and noted the proposed reduction of the Forensic Art Unit would also reduce the workload for the Unit. Commissioner Jordan stated she was a strong supporter of the MDPD and concurred with Commissioner Bell’s comments. She also noted she could not support this proposed resolution as presented. Chairman Diaz stated he supported Commissioner Heyman initially on this proposed resolution. He stated that he met with the MDPD Director and the County Manager following the last Committee meeting and was informed the reduction in staff would not impact operations. Commissioner Heyman noted she would have raised this issue with any MDPD Director. She reiterated her concern for all the agencies that relied on the MDPD Forensic Art Unit’s services and the potential for the Unit to be unable to continue to provide this service. Mr. Loftus noted the Unit would assist agencies on an as need basis and would provide awareness and training for other agencies. The motion by Commissioner Heyman failed by a vote of 1-4, (Commissioner Heyman voted “Yes”; Commissioners Bell, Edmonson, Jordan, and Chairman Diaz voted “No”; and Commissioner Souto was absent). Later in the meeting in response to Chairman Diaz’ question regarding this item, Assistant County Attorney Gerald Sanchez stated that in order to lay this matter on the table, the Committee needed to consider a motion to that effect. Following Assistant County Attorney Sanchez’ advice, the Committee proceeded to vote to table the foregoing proposed resolution and its accompanying report Agenda Item 7A, Legislative File No. 110091.

TITLE
RESOLUTION ESTABLISHING COUNTY POLICY TO ALLOCATE FISCAL YEAR 2009-10 UNALLOCATED GENERAL FUND CARRYOVER TO FUND A POLICE FORENSIC ARTIST FOR FISCAL YEAR 2010-11; DIRECTING COUNTY MAYOR OR MAYOR’S DESIGNEE TO PREPARE AN APPROPRIATE BUDGET AMENDMENT TO THE FISCAL YEAR 2010-11 COUNTY BUDGET TO EFFECTUATE THE FOREGOING

BODY

WHEREAS, as part of the County’s Fiscal Year 2010-11 adopted countywide budget (the “Budget”), a Police Forensic Artist position was eliminated; and
WHEREAS, there is approximately $9.411 million of 2009-10 unallocated carryover, of which $3.976 million will be carried over to the various budgets in the Board of County Commissioners fund as required by Section 2-1799 of the Code of Miami-Dade County and $750,000 will be allocated to fund the community periodical program for fiscal year 2010-11 pursuant to Resolution No. R-1116-10; and
>>WHEREAS, because of cost saving efficiencies implemented by all general fund supported departments and the recent allocation by the Board to the general fund from the Office of the Chair Division of the Board of County Commissioner Fund it is anticipated that additional 2009-10 unallocated carryover will be identified once the budgets for all such departments are closed out; and<<
WHEREAS, the [[remaining $4.685 million]] >>2009-10 unallocated carryover (other than such amounts carried over to the various budgets in the Board of County Commissioners fund)<< is available for appropriation to fund eligible programs and uses, including a Police Forensic Artist position; and
WHEREAS, this Board wishes to establish as its policy to allocate Fiscal Year 2009-10 unallocated general fund carryover to fund a Police Forensic Artist position for Fiscal Year 2010-11 in an amount equal to $88,575.00; and
WHEREAS, Section 129.06(2), Florida Statutes, and Section 1.02A of the Miami-Dade County Home Rule Charter authorize the Board of County Commissioners to amend the general fund budgets and establish procedures for doing so; and
WHEREAS, this Board desires to amend the Budget by appropriating $88,575.00 from Fiscal Year 2009-10 unallocated general fund carryover to the Miami-Dade Police Department budget to fund a Police Forensic Artist position for Fiscal Year 2010-11; and
WHEREAS, accordingly, this Board desires to direct the County Mayor or the Mayor’s designee to prepare the appropriate budget amendment to the Budget to effectuate the foregoing and bring such amendment back to the Board for its approval as part of the mid-year budget amendment process,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. The foregoing recitals are incorporated in this resolution and are approved.
Section 2. This Board wishes to establish as its policy to allocate Fiscal Year 2009-10 unallocated general fund carryover to fund a Police Forensic Artist position for Fiscal Year 2010-11 in an amount equal to $88,575.00.
Section 3. The County Mayor or the Mayor’s designee is hereby directed to prepare the appropriate budget amendment to the Budget to effectuate the foregoing and to bring such amendment back to the Board for its approval as part of the mid-year budget amendment process.
