TITLE
RESOLUTION TO APPOINT ONE BOARD MEMBER TO THE AGRICULTURAL PRACTICES ADVISORY BOARD

BODY
WHEREAS, Sections 2-931 through 2-933 of the Code of Miami-Dade County provides for the creation, composition, terms, purpose and duties of the Agricultural Practices Advisory Board; and

WHEREAS, Mr. Jorge Abreu, Florida Nursery, Growers and Landscape Association Nursery Industry Representative #2 submitted a letter of resignation from the Agricultural Practices Advisory Board on May 1, 2011; and

WHEREAS, a vacancy of the Nursery Industry Representative #2 exists on the Agricultural Practices Advisory Board due to the resignation of Mr. Jorge Abreu; and

WHEREAS, Section 2-935 of the Code of Miami-Dade County directs that vacancies on the APAB are to be filled by the Board of County Commissioners; and

WHEREAS, the Florida Nursery, Growers and Landscape Association has submitted r�sum�s for Mr. Sanford Stein and Mr. Christopher Oppenheimer, and has recommended Mr. Sanford Stein as their first choice to fill the vacancy for Nursery Industry Representative #2; and

WHEREAS, the County Mayor and the Florida Nursery, Growers and Landscape Association have recommend that the Board of County Commissioners appoint Mr. Sanford Stein to the Nursery Industry Representative #2 seat,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that Mr. Sanford Stein is hereby appointed to the Nursery Industry Representative #2 seat of the Agricultural Practices Advisory Board for the remainder of the four-year term to expire December 31, 2012.

STAFF RECOMMENDATION
Recommendation
It is recommended that the Board of County Commissioners (BCC) appoint the following person to replace a resigning Board Member on the Agricultural Practices Advisory Board (APAB):
Sanford Stein to fill the Nursery Industry Representative #2 seat as recommended by the Florida Nursery Growers and Landscape Association.

Scope
The Agricultural Practices Advisory Board has a countywide impact.

Fiscal Impact/Funding Source
There is no fiscal impact to the County.

MANAGER'S BACKGROUND
Background
The APAB consists of thirteen members representing a variety of agricultural industries. Section 2-935, Code of Miami-Dade County, requires that the BCC fill vacancies occurring on the APAB. By Code, each nominating organization must submit for BCC review a minimum of one nominee for their vacant position(s), the nominee�s resume and the minutes of the organization�s meeting at which the nominee was selected. The required documentation for each of the following nominees is attached.

On May 1, 2011, Mr. Jorge Abreu submitted a letter of resignation from the APAB due to personal issues. However, Mr. Abreu agreed to remain on the APAB until a replacement candidate is nominated. Mr. Abreu is one of two Nursery Industry Representatives nominated to the APAB by the Florida Nursery, Growers and Landscape Association (FNGLA). His current term began on January 1, 2009 and ends on December 21, 2012. On August 2, 2011, the BCC adopted an ordinance that amended Section 2-934 of the Code of Miami-Dade County to allow members of the APAB to serve until a successor has been appointed.

Nursery Industry Representative #2 seat:

* Mr. Sanford Stein was nominated by the FNGLA as one of two candidates to replace resigning Board Member Jorge Abreu. Mr. Stein is the owner of The Jungle Nursery located in Homestead, and has served on the Board of Directors for the Miami-Dade Chapter of FNGLA and the Dade County Farm Bureau. Mr. Stein has a Bachelor�s degree from the University of Florida, a Master�s Degree from the University of Miami and is a licensed mental health counselor. The Florida Nursery, Growers and Landscape Association recommended the appointment of Mr. Sanford Stein as their preferred candidate at their May 16, 2011 meeting.

* Mr. Christopher Oppenheimer was nominated by the FNGLA as an alternate candidate to replace Board Member Jorge Abreu. Mr. Oppenheimer is currently a manager at Botanics Wholesale, Inc. located in Homestead. Mr. Oppenheimer has served on the Dade County Agri-Council, the Dade County Chapter of the Florida Foliage Association, Florida Urban Forestry Council, the FNGLA, the Great Southern Tree Conference and the Dick Fuhr Memorial Fishing Tournament. Mr. Oppenheimer has a Bachelor�s degree from Florida International University. The Florida Nursery, Growers and Landscape Association recommended the appointment of Mr. Christopher Oppenheimer as an alternate candidate at their May 16, 2011 meeting.
