REPORT: | First Assistant County Attorney Abigail Price-Williams read the foregoing proposed ordinance into the record. Assistant County Attorney Abbie Schwaderer advised that this proposed ordinance should be amended to change the language contained within the first sentence in Section 2-934 to read as follows: “Notwithstanding anything in the Code to the contrary, members shall be appointed for terms of four years without term limits.” Hearing no other questions or comments, the Commission proceeded to vote on this proposed ordinance as amended. The amended version of the ordinance was assigned Ordinance No. 11-58. | ||||||

TITLE ORDINANCE AMENDING SECTION 2-934 OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA; PERTAINING TO THE AGRICULTURAL PRACTICES ADVISORY BOARD; ELIMINATING TERM LIMITS; PROVIDING THAT A MEMBER MAY SERVE UNTIL HIS OR HER SUCCESSOR HAS BEEN APPOINTED AND QUALIFIED; PROVIDING SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE BODY BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA: Section 1. Section 2-934 of the Code of Miami-Dade County, Florida, is hereby amended to read as follows:1 Sec 2-934. Terms[[; term limits]]. >>Notwithstanding anything in the Code to the contrary, m<<[[M]]embers shall be appointed for terms of four years>>without term limits.<< [[, and no member may serve more than two terms, consecutive or otherwise. Members of the Board as of the effective date of this ordinance (�Current Members�) shall serve out the terms for which they were appointed. Thereafter, Current Members who have served only one term may be reappointed for one four-year term. Current members who have served two or more terms may not be reappointed to the Board.]] >>A member may serve until his or her successor has been duly appointed and qualified.<< Section 2. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity. Section 3. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance, including any sunset provision, shall become and be made a part of the Code of Miami-Dade County, Florida. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. Section 4. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board. 1 Words stricken through and/or [[double bracketed]] shall be deleted.
