REPORT: | Assistant County Attorney Gerald Sanchez read the foregoing proposed resolution into the record. Chairman Diaz relinquished the chair to Vice-Chairwoman Heyman. Pursuant to Commissioner Jordan’s request, Assistant County Attorney Karon Coleman advised that this proposed ordinance was necessary to allow the University of Miami (UM) to take advantage of recently passed legislation regarding sovereign immunity. She clarified that this basic affiliation agreement was to be with a teaching hospital that was operated by a public entity. She noted, for the record, the differences between this proposed basic affiliation agreement and the previous one were the following: • That the basic affiliation agreement include an indemnification clause; • That the public records act be acknowledged to apply to the portion of the university that provided the services under the basic affiliation agreement; • That the County relationship with UM be expanded to include the supervision and training of medical students; • That the County relationship with UM be expanded to include the services provided by all health professionals that worked for UM within Jackson Health System; • That this relationship was between UM and Jackson Health System, as opposed to Jackson Memorial Hospital; • That the concept of a medical center geographically located at the UM/Jackson Memorial Hosptial campus be removed. Commissioners Bovo, Souto, Jordan, and Vice-Chairwoman Heyman asked that they be listed as co-sponsors. Mr. Carlos Migoya, President, Jackson Health System, noted the entire community would benefit from sovereign immunity. Mr. Pascal Goldschmidt, Dean, UM Miller School of Medicine, expressed appreciation for the Committee’s support. He pointed out that this proposed basic affiliation agreement allowed for additional affiliations by Jackson Health System. The Jackson Health Systems service chiefs introduced themselves. Hearing no other questions or comments, the Committee proceeded to vote. Chairman Diaz resumed the chair. Chairman Diaz asked Deputy Mayor Genaro Iglesias to prepare an appropriate memorandum asking Chairman Martinez to waive the Board’s rules and procedures to allow this proposed resolution to be heard at November 3, 2011, meeting. | ||||||

TITLE RESOLUTION APPROVING THE 2011 BASIC AFFILIATION AGREEMENT BETWEEN THE PUBLIC HEALTH TRUST OF MIAMI-DADE COUNTY, FLORIDA AND THE UNIVERSITY OF MIAMI BODY WHEREAS, the Financial Recovery Board of the Public Health Trust at its September 26, 2011 meeting passed and adopted Resolution No. PHT 09/11-039; and WHEREAS, the Public Health Trust of Miami-Dade County, Florida and the University of Miami desire to enter into the 2011 Basic Affiliation and to therefore supersede and replace the 2004 Basic Affiliation Agreement; and WHEREAS, the Public Health Trust is currently governed by the Financial Recovery Board of the Public Health Trust pursuant to Chapter 25A-9 of the Code of Miami-Dade County and Board of County Commissioners Resolution No. 392-11; and WHEREAS, Section 25A-4(c)(2) of the Code of Miami-Dade County requires the approval of the Board of County Commissioners prior to the Public Health Trust and the University of Miami entering into this 2011 Basic Affiliation Agreement, NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA that this Board hereby approves the 2011 Basic Affiliation agreement between the Public Health Trust of Miami-Dade County, Florida and the University of Miami in accordance with the requirements of Chapter 25A of the Code of Miami-Dade County, Florida. |
