REPORT: Hearing no objection, members of the Board considered Agenda Items 8M7 and 8M8 simultaneously. Commissioner Bell asked whether the State required the County to pay for speed signs placed at older schools and the School Board to pay for signs placed at newer schools. Ms. Esther Calas, Director, Public Works & Waste Management Department, clarified that in the early 1990s, the County Commission directed the School Board to pay for traffic control devices installed at new schools or developments. She noted prior to that time, signs were paid for from the Liability Trust Fund until exhausted and then from the PTP funds as they became available. Commissioner Bell noted it appeared as though the County was paying for speed signs placed at newer schools. She questioned the criteria used to determine whether a school was old or new. Ms. Calas explained that because some drivers were not adhering to the speed limit zones at some high schools, the County placed Electronic Speed Feedback Signs (Your Speed Signs) at those schools as a safety measure. She clarified that the Citizens Independent Transportation Trust (CITT) funds were identified as the funding source for the Your Speed Signs, and the School Board was responsible for the cost of flashers. Commissioner Bell inquired and Ms. Calas confirmed that the ‘Your Speed Signs’ were the type of signs addressed in Agenda Items 8M7 and 8M8. Hearing no further questions or comments, members of the Board proceeded to vote on this proposed resolution as presented.

FOR THE PEOPLE�S TRANSPORTATION PLAN PROJECT ENTITLED ELECTRONIC SPEED FEEDBACK SIGNS (PROJECT MCC 7360 PLAN � CICC 7360-0/08, REQUEST FOR PRICE QUOTATION NO. 20110104) AND AUTHORIZING THE USE OF CHARTER COUNTY TRANSPORTATION SURTAX FUNDS

..Recommendation
The attached Contract Award Recommendation for the People�s Transportation Plan (PTP) project entitled Electronic Speed Feedback Signs (Project MCC 7360 Plan - CICC 7360-0/08 Request for Price Quotation (RPQ) No. 20110104) in the amount of $464,355.97 to AGC Electric, Inc., was prepared by the Public Works and Waste Management Department (PWWMD) and is recommended for approval by the Board of County Commissioners (BCC).

Proceeds from a Charter County Transportation System Sales Surtax Bond Sale will be used to fund this project; therefore, review by the Citizens� Independent Transportation Trust (CITT) is required before final approval by the BCC.

Scope
The work to be performed under the life of this Contract includes the installation of electronic speed feedback signs at various locations within Miami-Dade County (County).

Fiscal Impact/Funding Source
The value of this contract award is $464,355.97 and will be funded from Charter County Transportation Surtax 2010 Bond Proceeds as programmed within PWWMD�s Multi-Year Capital Budget. The base contract amount is $396,746.40, with the total amount being inclusive of contingency and dedicated allowance amounts. There are no recurring operation or maintenance costs anticipated with this Contract.

The proposed improvements qualify under the allowable work categories included in the PTP Neighborhood Improvements Section. The funding index code for this project is CPEPTP600SCH.

Delegation of Authority
No additional authority is being requested within the body of this Contract.

Track Record/Monitor
AGC Electric, Inc. is currently performing work for PWWMD at a satisfactory level. PWWMD has reviewed the Capital Improvements Information System (CIIS) database and found 16 awarded construction contracts as follows:

* one for the Internal Services Department (ISD), and
* 15 for PWWMD.

The referenced database also lists a total of seven contractor performance evaluations with an overall performance rating of 3.7 (satisfactory performance) out of a possible 4.0 (superior performance) rating.

The Sustainability, Planning and Economic Enhancement Department (SPEED) History of Violations report lists no violations for this Contractor.

According to the Florida Department of State, Division of Corporations, AGC Electric, Inc., Company Principals are Tomas V. Curbelo, Enrique I. Guzman and Pierrette De La Sierra and the Company�s address is listed as 2600 West 79 Street, Hialeah, Florida 33016.

Following PWWMD�s standard operating procedures, after award of this Contract, a pre-construction meeting will be scheduled. The responsible staff person for all PTP projects in PWWMD is Mr. Frank Aira, P.E.. Following completion of the award process, the project will be assigned to Mr. Oscar Rubio, Project Coordinator, for day-to-day responsibilities.

BODY
As part of the PTP Neighborhood Improvements initiative, PWWMD continues to take advantage of various contracting mechanisms such as the Miscellaneous Construction Contract (MCC) process available under the MCC 7360 Program. Through this process, PWWMD forwards a RPQ by way of facsimile transmission to a pool of firms that have registered with ISD for the respective trade. Additionally, PWWMD advertises the project in the Daily Business Review and all solicitations are available on-line through the Miami-Dade County portal under the �Procurement Solicitations� link. The project�s award evaluation is based upon the bid submitted by the lowest responsive, responsible bidder for the project.

PWWMD staff submitted the referenced project to the SPEED Review Committee. The Review Committee met on July 19, 2011, reviewed RPQ No. 20110104, and recommended no measures. A Community Workforce Program Goal of 13.90 percent has been established for this project as several work locations fall within a Designated Target Area. On August 11, 2011, PWWMD forwarded an RPQ for the PTP Electronic Speed Feedback Signs Project, utilizing the MCC 7360 Plan - CICC 7360-0/08, to a list of 42 pre-registered firms. A total of seven firms purchased contract documents and all seven firms proffered a bid.

On September 21, 2011, AGC Electric, Inc. proffered the lowest responsive, responsible base bid of $396,746.40, eighteen percent below the County�s cost estimate; the second lowest bidder, Under Power Corp. proffered a base bid of $432,098.80, nine percent over the lowest bidder; and the third lowest bidder, Brailly Electric Corp. proffered a base bid of $438,708.00, two percent over the second lowest bidder. Based on the results of the solicitation, PWWMD issued a recommendation of award on September 30, 2011 for RPQ No. 20110104 to AGC Electric, Inc., with the stipulation that approval for this project must be obtained from the CITT and the BCC in accordance with PTP guidelines.

The work to be accomplished for this project consists of, but is not limited to, furnishing all supervision, labor, required materials, equipment and tools to perform all operations necessary for the furnishing and installing of new solar powered electronic speed feedback signs, pedestrian poles, foundations, pullboxes, conduit, and service wire as shown in the contract plans and specifications at designated locations.
