TITLE RESOLUTION RATIFYING EMERGENCY PURCHASES IN THE AMOUNT OF $4,748,050 AND AUTHORIZING WAIVER OF FORMAL BID PROCEDURES FOR THE PURCHASE OF GOODS AND SERVICES TO ADDRESS UNANTICIPATED WATER AND SEWER NEEDS, WAIVING THE REQUIREMENTS OF SECTION 2-8.1 OF THE COUNTY CODE, AND SECTION 5.03(D) OF THE HOME RULE CHARTER, BY A TWO-THIRD VOTE OF THE BOARD MEMBERS PRESENT, AND AUTHORIZING THE COUNTY MAYOR OR THE COUNTY MAYOR�S DESIGNEE TO AWARD SAME, WITH AUTHORITY TO EXERCISE OPTIONS-TO-RENEW ESTABLISHED THEREUNDER BODY WHEREAS, the County Mayor recommends to this Board to ratify emergency purchases and waive formal bid procedures for the purchase of goods and services which cannot be purchased under normal bid procedures, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board ratifies emergency purchases in the amount of $4,758,050 and waives formal bid procedures for the purchase of goods and services to address unanticipated water and sewer needs, and authorizes the County Mayor or County Mayor�s designee to award such contracts, with authority to exercise options-to-renew established thereunder, pursuant to Section 5.03(D) of the Home Rule Charter and Section 2-8.1 of the County Code by a two-thirds (2/3s) vote of the Board members present. Gimenez Mayor Subject:Resolution Authorizing Emergency Purchases for the Water and Sewer Department ..Recommendation It is recommended that the Board of County Commissioners (Board) waive competitive bidding procedures for the attached contracts to purchase goods and services pursuant to Section 2-8.1 of the County Code and Section 5.03(D) of the Home Rule Charter, in the best interest of Miami-Dade County. More specifically, this item will ratify the emergency purchase of services required to address unanticipated water and sewer infrastructure needs. Scope The location of these projects is listed in the Background Section of this memorandum. Fiscal Impact/Funding Source Proprietary revenues generated by the Water and Sewer Department (WASD) covered these unanticipated costs. Track Record/Monitor There are no known performance issues with the vendors recommended for award in the accompany Bid Waiver Package. WASD�s contract manager is reflected in the accompanying package. Delegated Authority This item approves the action of the County Mayor or County Mayor�s designee to exercise emergency purchase of services required to address unanticipated water and sewer infrastructure needs. BODY The County awarded two emergency contracts to address the unforeseen, urgent and immediate need to rehabilitate sewer lines and prevent wastewater spills pursuant to Administrative Order 3-38. The first emergency contract was to repair the 72-inch pipe at NW 156th Street and NW 17th Avenue and Biscayne Canal. This repair was necessitated by a report that revealed imminent failure of a wastewater force main. As a result, the WASD Director certified an emergency purchase on April 19, 2011 to rehabilitate 8,045 linear feet of a 72-inch sewer force main to prevent a wastewater spill. The emergency contract award was in the amount of $4,616,050 and this project is located in Commission District 1. The second emergency contract was for the rehabilitation of a 60-inch water main pipe at SW 72nd Street and SW 97th Avenue. This repair was necessitated because two segments of the raw water main pipe were identified as a priority to prevent a catastrophic failure of the water distribution system. WASD approved the immediate rehabilitation of these two segments at this location on September 6, 2011. The emergency contract award was in the amount of $132,000 and this project is located in Commission District 7. Pursuant to Administrative Order 3-38, these emergency contracts are now before the Board for ratification. __________________________ Deputy Mayor |
