TITLE
RESOLUTION DECLARING THREE (3) GENETIC ANALYZERS SURPLUS AND AUTHORIZING DONATION TO FLORIDA INTERNATIONAL UNIVERSITY

BODY
WHEREAS, the instruments described below are owned by Miami-Dade County; and

WHEREAS, the instruments are unserviceable, and usage by Miami-Dade County is uneconomical and inefficient and the instruments serves no useful purpose; and

WHEREAS, Florida International University (the �Donee�) desires to use the instruments only within Miami-Dade County to enhance its ability to train students in forensic science methods; and

WHEREAS, the Donee is an �eligible community based organization� pursuant to Section 2-11.2.1(a)(3) of the Code of Miami-Dade County, and is also eligible to receive the instruments pursuant to Florida Statutes sections 274.05 and 273.01; and

WHEREAS, the equipment may only be used by the Miami-Dade Police Department Forensic Services Bureau Crime Laboratory and no other Miami-Dade County agency would be able to use this equipment; and

WHEREAS, the instruments are eligible for donation under Section 274.05 of the Florida Statutes, and Section 2-11.2.1. of the Code of Miami-Dade County,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that

Section 1. This Board declares the following equipment, with listed value and other characteristics, to be surplus pursuant to Section 274.05 of the Florida Statutes, and Section 2-11.2.1 of the Code of Miami-Dade County;

Section 2. This Board authorizes the donation of three (3) genetic analyzers to the Donee. The Donee shall take possession of the equipment within sixty (60) days of the effective date of this Resolution and shall be responsible for any and all costs of transferring the equipment. The County Mayor or designee shall and is hereby directed to take any and all actions necessary to effectuate the intent of this resolution.

Section 3. If, for any reason, the Donee fails to take possession of the equipment within sixty (60) days of the effective date of this Resolution, then this Resolution shall be null and void, and the ownership rights to the equipment shall revert back to the County.

STAFF RECOMMENDATION
Recommendation
It is recommended that the Board of County Commissioners approve the attached resolution supporting the County Mayor or County Mayor�s Designee action to authorize the donation of three (3) genetic analyzers to the Florida International University International Forensic Research Institute from the Miami-Dade Police Department, Forensic Services Bureau, Crime Laboratory.

Scope
The equipment will be used by students at the Florida International University, a public institution.

Fiscal Impact/Funding Source
Miami-Dade County would not incur any costs.

Track Record/Monitor
The donation of surplus equipment from the Miami-Dade Police Department will be conducted in compliance with Florida Statutes and Miami-Dade County Code.

MANAGER'S BACKGROUND
Background
The Miami-Dade Police Department, Forensic Services Bureau, Crime Laboratory routinely analyzes DNA as one of its responsibilities. Considerable equipment is used in carrying out these analyses. The genetic analyzers to be donated are an average of 13 years old and are costly to service and maintain.

The Florida International University has a forensic science program which could use the equipment to train students on industry standard equipment. These instruments will support undergraduate and graduate research in forensic science. This equipment would be used to support the training effort in a forensic biology laboratory class and also a summer workshop on DNA instrumentation and analyses.
