TITLE
RESOLUTION AMENDING IMPLEMENTING ORDER 4-42 (DEPARTMENT OF ENVIRONMENTAL RESOURCES MANAGEMENT) TO PROVIDE FEES FOR THE REVIEW OF CERTAIN ACTIVITIES THAT WILL NO LONGER REQUIRE NATURAL RESOURCE PERMITTING AND FOR THE REVIEW OF EXPEDITED ADMINISTRATIVE AUTHORIZATIONS AND TO UPDATE THE NAME OF THE DEPARTMENT

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board approves the amendments to Implementing Order 4-42: Department of Environmental Resources Management to provide fees for the review of certain activities that will no longer require natural resource permitting and for the review of expedited administrative authorizations and to update the name of the department, in substantially the form attached hereto and made a part hereof.

STAFF RECOMMENDATION
Recommendation
It is recommended that the Board of County Commissioners (Board) approve the attached resolution amending Implementing Order 4-42: Fee Schedule for the Department of Regulatory and Economic Resources. This resolution is related to a companion ordinance and provides fees for the review of regulated activities that will no longer require natural resource permits, provides fees for the review of expedited administrative authorizations and updates the name of the department.

Scope
The scope of this resolution is countywide.

Fiscal Impact/Funding Source
If the proposed companion ordinance is adopted and the proposed fees established, fewer natural resource permits will be required and the public will pay less to conduct regulated activities. Miami-Dade County’s reduction in permit fee revenue is estimated at $10,000 annually.

Track Record/Monitor
The Assistant Director of the Department of Regulatory and Economic Resources will be responsible for implementing the changes proposed by this resolution.

MANAGER'S BACKGROUND
Background
The accompanying ordinance proposes to amend several sections of Chapter 24 of the Code of Miami-Dade County relating to natural resource permitting for work in tidal waters and wetlands throughout the County and to update the department name.  The proposed amendments also include expanding the list of projects that will continue to be reviewed but will no longer require permits. These “Expedited Administrative Authorizations” have fees for the review of required information and will cost the applicant less than the currently required permits. These proposed changes to Implementing Order 4-42 are shown on pages 9, 10 and 13. In addition to the fee changes, the existing Implementing Order 4-42 refers to the Department of Environmental Resources Management (DERM), which has been merged into the Department of Regulatory and Economic Resources, and also updated in the proposed amendments.
