TITLE RESOLUTION APPROVING AMENDMENT NUMBER TWO TO THE NON-EXCLUSIVE PROFESSIONAL SERVICES AGREEMENT WITH AECOM TECHNICAL SERVICES, INC. TO PROVIDE ADDITIONAL ENGINEERING SERVICES RELATING TO THE 54-INCH SANITARY SEWAGE FORCE MAIN BETWEEN VIRGINIA KEY AND FISHER ISLAND; INCREASING TOTAL COMPENSATION BY $1,100,000 MILLION FROM $7,150,000 TO $8,250,000 MILLION; AND AUTHORIZING THE COUNTY MAYOR OR DESIGNEE TO EXECUTE SAME AND EXERCISE THE PROVISIONS CONTAINED THEREIN BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference, and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby approves Amendment Number Two to the non-exclusive professional services agreement with AECOM Technical Services, Inc., increasing total compensation by $1,100,000 million from $7,150,000 to $8,250,000 million to provide additional engineering services for the preparation of the design-build criteria package for the replacement of the defective segments of the 54-inch sanitary sewage force main between Fisher Island and the Central District Wastewater Treatment Plant at Virginia Key for the Miami-Dade Water and Sewer Department, in substantially the form attached hereto and made a part hereof; and authorizing the County Mayor or Mayor�s designee to execute same and exercise the provisions contained therein for and on behalf of Miami-Dade County, Florida. Gimenez Mayor Subject: Resolution approving Amendment Number Two to Miami-Dade Water and Sewer Department Contract No. E07-WASD-09, a non-exclusive Professional Services Agreement with AECOM Technical Services, Inc., which increases total compensation by $1,100,000, from $7,150,000 to $8,250,000 ..RECOMMENDATION It is recommended that the Board of County Commissioners (Board) approve Amendment Number Two to Miami-Dade Water & Sewer Department (WASD) Contract No. E07-WASD-09, a non-exclusive Professional Services Agreement with AECOM Technical Services, Inc., formerly known as Earth Tech Consulting, Inc. The amendment increases total compensation by $1,100,000 from $7,150,000 to $8,250,000 for additional engineering services to replace defective segments of the 54-inch sewer pipe installed from Virginia Key to Fisher Island. Amendment Number Two for Contract No. E07-WASD-09 is related to another item on this agenda, Amendment Number One for Contract No. DB10-WASD-01 ESP with Ric-Man Construction, Inc. Amendment Number One also increases total compensation by $22,543,550.26, from $54,892,728.57 to $77,436,278.83, and extends the contract term by 210 days, from January 17, 2013 to August 15, 2013. Amendment Number One is for the replacement of the existing 54-inch sewer force main with a 60-inch sewer force main from Fisher Island across Government Cut to the point of interconnection to the City of Miami Beach�s 54-inch sewer force main. The commonality between both agenda items is the existing condition of various segments of the 54-inch sewer force main which are in imminent danger of failure. SCOPE OF AGENDA ITEM The item has county-wide significance although the sewer facilities to be constructed are located in Districts 5 and 7. FISCAL IMPACT/FUNDING SOURCE Amendment Number Two will increase total compensation by $1,100,000 and is funded by a combination of WASD�s Water Renewal and Replacement Fund, Wastewater Plant Expansion Fund and Revenue Bonds. The term of Amendment Number Two will expire on December 17, 2018 as determined by Amendment Number One which was approved by the Board on May 4, 2010 authorizing an extension to the original agreement. TRACK RECORD/MONITOR WASD�s Government Cut Project Manager, Eduardo A. Vega, P.E., will monitor this agreement. BODY On December 2, 2008, the Board approved Resolution No. R-1349-08 awarding Contract No. E07-WASD-09 to AECOM Technical Services, Inc. for total compensation of $4,400,000. The scope of work provided for a design criteria package including permitting, surveying, land rights acquisition, procurement, and post design services during construction of a utility tunnel to encase the replacement of the 54-inch sewer force main crossing Government Cut from Miami Beach to the County�s Central District Wastewater Treatment Plant on Virginia Key, and for the replacement of a 20-inch water main crossing Fisherman�s Channel from Port Island to Fisher Island. The existing 54-inch sewer force main transmits all sewage collected from Miami Beach, Surfside, Bal Harbour, Bay Harbor Islands and Fisher Island for treatment and disposal. Both pipelines were in conflict with the proposed dredging route for the Miami Harbor Federal Navigation Project which will allow large container vessels to access the Port of Miami in 2014. The initial deadline to complete the replacement of both pipelines was December 2012. By 2009, AECOM had completed almost 95% of the design criteria services to replace the 20-inch water main, and a utility tunnel to encase the 54-inch sewer pipeline from Miami Beach to Virginia Key, see the red line on Exhibit A as attached. As such, the 20-inch water main was replaced with a new 24-inch water main and was placed into service in April 2012. However, on-going permitting delays and difficulties obtaining the necessary easements expeditiously for the proposed utility tunnel led WASD to decide to revise the original design criteria of the project for the 54-inch sewer force main. This was done to make sure the Department�s projected project completion date for the replacement of the 54-inch sewer pipeline is met. The revision eliminated the design criteria for the utility tunnel from Miami Beach to the County�s Central District Wastewater Treatment Plant at Virginia Key with a new design criteria package that runs the 54-inch sewer force main only from Fisher Island to south of Miami Beach, see the green line on Exhibit A. On May 4, 2010, the Board approved Resolution R-511-10 authorizing Amendment Number One to the original contract which provided for total additional compensation in the amount of $2,750,000 to modify the design criteria package as described directly above and to extend the agreement for a period of four years to December 17, 2018. During 2010, AECOM Technical Services Inc. completed the modification of the design criteria package for the relocation of the sewer force main and the project was successfully bid in early 2011. The construction of the replacement sewer force main is now anticipated to be completed by July 2013, which is compatible with the Miami Harbor Federal Navigation Project schedule. Since the 54-inch sewer force main had not yet been replaced, in December of 2011, when specialized testing equipment became available, WASD had the entire length of the active pipe inspected from the Central District Wastewater Treatment Plant at Virginia Key to the point of interconnection to the City of Miami Beach�s sewer force main. The inspection revealed that numerous segments of the 54-inch sewer force main pipe are in a severely distressed condition and in imminent danger of failure. This condition assessment requires yet another revision to the design criteria package to replace the 54-inch sewer force main with a 60-inch force main from Virginia Key to Fisher Island. Amendment Number Two increases total compensation by $1,100,000 to provide the services needed for the replacement of this portion of the force main. This increase will allow AECOM Technical Services, Inc. to expeditiously prepare the design-build criteria package needed to issue a request for bids for a design-build contract to replace this portion of the defective 54-inch sewer force main with a 60-inch sewer force main which will also accommodate growth, see the yellow line on Exhibit A. The Community Business Enterprise goal of 26% was established as a part of the original contract and Amendment Number One and to date AECOM Technical Services, Inc. has complied with all the threshold requirements and the participation goals. The 26% CBE goal will also be applied to the additional compensation in Amendment Number Two. Approval of this amendment will further expedite the replacement of the last segment of the high risk pipeline from Miami Beach to the Central District Wastewater Treatment Plant at Virginia Key. __________________________ Alina T.
